RECOMMENDATION: Staff recommends modification of the exception request, EXC-2006-08, and the approval of a smaller monument sign with a maximum height of 11 feet, 5 inches, based on the model resolution. BACKGROUND: In 2005, the property owner, Tom Harrington, sought to expand and modernize the appearance of a 1960's style shopping center, known as the Homestead Crossing Shopping Center. The center appears to be part of a larger shopping center that is actually located in the town of Los Altos. The Planning Commission approved the planning permits for this proposal on September 13, 2005 (file nos. U-2005-11, ASA- 2005-07). Part of this approval included a condition to modernize the old signage to meet the City's Sign Code or seek a Sign Exception for any variances. DISCUSSION: Here is a picture of the existing center ground sign, which is located at the northwest corner of the parcel and oriented toward Homestead Road traffic. No. of Tenant Names The expansion of the center added two net new tenant spaces. As these commercial tenant spaces have limited street visibility and have historically had exposure from the ground sign, staff is supportive of the exception for additional tenant names on the sign. Location Within Sidewalk Site Triangle The Sign Code prohibits a ground sign from locating too close to a driveway opening (aka, sidewalk site triangle) for traffic safety reasons. The present sign is located in this triangle and the proposed sign is suggested to be in the same location. City traffic engineering staff has visited the site and reviewed the proposal. They note that the new ground sign can be located in the site triangle without obstructing views of Homestead Road traffic because the sidewalk is very wide in this area (10 feet). Staff is requiring a 3-foot setback from the sidewalk to prevent obstruction of traffic views. Other Issues There is other information on the ground sign: the center name and the street addressing. The City allows the street addressing in addition to the sign area, but the center name, HOMESTEAD CROSSING, should be incorporated in the signage area. The code states that the center name of a shopping center shall be emphasize on the sign. Staff is recommending that the center name be incorporated in the 8' by 8' signage area. Findings for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and Intent of Sign Ordinance The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "promote attractive and effective signs." The property is unusual for a commercial lot, in that it has a narrow street frontage in relation to the length of the building, which sides on the lot. Existing commercial tenants would not have sufficient sign area under sign ordinance allowances. Additional sign height is also warranted. Because of the narrowness of the lot, the property owner does not control all of the land surrounding the sign and cannot maintain the surrounding landscape to prevent it from obscuring the signage information. The sidewalk is wide enough so that Homestead traffic views are not obscured by the sign. C. Least Modification and Minimum Variance to Accomplish Purpose The exception requests provide the minimum variances to allow for an effective and visible sign for this multi-tenant shopping center. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testjmony and other evidence submitted in this matter, the application no. EXC-2006-06, is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application EXC-2006-06 as set forth in the Minutes of the Design Review Committee Meeting of January 18, 2007, and are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on the sign exhibits titled: "Homestead Shopping Center Tenant Improvement, 22350-22382 Homestead Road, Cupertino, CA 95014" consisting of one page, and exhibits titled: "Homestead Crossing" consisting of 4 pages that are unlabeled, except as may be amended by conditions contained in this resolution. 2. GROUND SIGN AREA The proposed sign area shall be up to 64 square feet and shall incorporate the shopping center name in the sign area. Tenant names shall be at least 6 inches in height. 3. GROUND SIGN HEIGHT The maximum height of the ground sign shall be 11 feet, 5 inches. 4. GROUND SIGN SETBACK The sign shall be set back at least 3 feet from the inside edge of the sidewalk. 5. NUMBER OF TENANT NAMES ALLOWED ON GROUND SIGN This approval grants seven (7) tenant names on the ground sign. 5. NOTICE OF FEES, DEDICATIONS, RESERV A TIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions.
