Subject: Consider Amending Section 2.74.010 of the Municipal Code, Increasing the Number
of Technology, Information and Communication Commission Members to a Total of Seven and
Appointing Two New Commissioners.
Background:
The Technology, Information, and Communication Commission (TICC) was originally
instituted as the Cable Commission. Since its inception, the commission has advised the council
on those communication issues and technologies that have had an impact on city government and
city residents.
The commission currently consists of five members appointed by the city council to four-year,
overlapping terms. The commission provides support for community access television, especially
public and educational access, and gives guidance when needed for development and
implementation of access channels and programming. The commissioners also advise the city
council on all matters relating to technology, information and communications within the City of
Cupertino, including evaluating compliance with any franchise or other agreements between the
City and communications providers and conducting periodic reviews of providers, facilities, and
products. Members of the commission serve as liaisons between the City, the public, and
communications providers. Moreover, the commissioners provide the community with education
and information regarding communications, technology and the industry as a whole.
The expansion of commission membership is expected to increase demands on staff.
Concurrently, the addition of two commissioners may allow the commission to more actively
address the full spectrum of technology, information, and communication issues that may
confront the city and its residents.
Recommendation: That the council consider amending section 2.74.010 of the municipal code,
increasing the number of TIC Commission members to seven, and appoint two new
commissioners.

AMENDING SECTION 2.74,010 OF THE CUPERTINO
MUNICIPAL CODE MODIFYING THE COMPOSITION OF
THE TECHNOLOGY, INFORMATION, AND
COMMUNICATIONS COMMISSION
THE CITY COUNCIL OF THE CITY OF CUPERTINO HEREBY ORDAINS AS
FOLLOWS:
1. Section 2.74.010 of the City's ordinance code is hereby amended to read as follows:
2.74.010 Established.
The Technology, Information, and Communications Commission (formerly
Telecommunications Committee Commission) of the Cityf is established and shall consist of five
seven members from among the qualified electors of the City, none of whom shall be officials or
employees of the City, nor cohabit with, as defined by law, nor be related by blood or marriage to
any member of the Commission, the City Manager or the staff person(s) assigned to this
Commission. Members of the Technology, Information, and Communications Commission shall
be appointed by the City Council.
Publication Clause
The City Clerk shall cause this ordinance to be published at least once in a newspaper of
general circulation, published and circulated in the City within 15 days after its adoption, in
accordance with Government Code Section 36933, and shall certify to the adoption of this
ordinance and shall cause this ordinance and her certification, together with proof of publication,
to be entered in the Book of Ordinances of the Council of this City.

On January 22, Council interviewed applicants for 2 openings on the TICe. Attached are
4 applications from applicants who were interviewed but not appointed.
Under the City's commission appointment guidelines, Council may choose to appoint
from those applicants already interviewed within 90 days without doing additional
interviews.
The 2 candidates receiving the most votes out of the 4 applicants interviewed but not
appointed were Luke Lam and Peter Friedland.
