BACKGROUND All user fees are reviewed each year in conjunction with the preparation of the budget. City policy is to ensure that, to the extent possible, fees cover the cost of providing services. The exceptions are solar permits which are priced below cost as an energy-saving incentive, while some fees are set based on what the market will bear, such as Sports Center memberships. Since building fees have already been approved to change on May 7, 2007, they are excluded from this resolution. Fees related to the new tree ordinance will be brought to the Council separately next month. The review and approval of housing mitigation fees are continued tonight from the March Council meeting. Specific proposals for this action are: General Fees: · Permit fees for massage establishments, handbills, solicitors and taxis were raised or lowered significantly based on a new study of time spent for inspections and processing. Almost all massage permit fees rise between 7% to 42%, with a renewal fee for the establishment itself dropping 40%. Initial handbill and solicitor permits drop 41 %, with renewal fees increasing 4% and 56%, respectively. Taxi permits go up 47% with renewals tripling in price due to the extent and time it takes to enforce the City's cab regulations. Noise variances are up 16% and dangerous dog registration fees drop 8%. Sign removals go up 87%. . Parking fines go up $1 to $36. . Certain other fees increase 3% to 5% due to the higher costs of providing the service. Planning Fees: . Review and approve housing mitigation fee increases, as discussed in the attached report and continued from the March 6 Council meeting. . Other planning fees are increased 5% based on City costs. /7-/ Printed on Recycled Paper Engineering Fees: . Up 5% to reflect the City's higher cost of providing the service. Recreation Fees: . Unchanged except for the discontinuation of fees at the closed Blackberry Farm retreat center and picnic grounds. Minor Less than 5,000 square feet commercial; less than 10,000 square feet office/industrial; less than eight residential units. Appeal A request from the project applicant or interested party to reverse or amend a decision made by staff or an advisory body. An appointed public official serving on the board that made the decision subject to the appeal, an appointed public official serving on a board that is directly affected by the decision and the City Council members are exempted from the fee requirement. Directors Application An application that receives final approval by staff either via an advertised public hearing or non-hearing format. The application may involve a pre-application meeting and/or Environmental Review committee reVIew. Temporary Sign Permit A staff review of a temporary sign application that includes an evaluation of the sign request, the entry into the temporary log and site review by Code Enforcement Officers. The permit fee is in addition to the submittal of a deposit to guarantee removal ofthe sign upon expiration of the temporary permit. Tentative Map: Five or more parcels. Parcel Map: Four or less parcels. Housing Mitigation Fee Fee collected is used to construct new affordable residential units for Cupertino residents and employees. The fees mitigate the need for affordable units caused by expanding offices, retail, hotel and industrial buildings creating new jobs and new residential development creating a need for more affordable development. · An impact fee shall be assessed on any new retail, hotel and office/industrial development applications. The following uses shall be exempt from the impact fee, but still required to provide Below Market Rate Housing as part of a residential development: projects in a redevelopment project area and mixed use projects providing two thirds residential and one third retail/office. · An in-lieu fee shall be assessed on all new residential units in developments of six units or less and all single family houses. NOTES: Mixed use applications will be classified based upon the highest intensity and review process. Determine the maximum hourly rate paid to instructor. 2. Multiply the instructor's hourly rate by the number of class meetings. 3. Determine the minimum number of participants and divide into the instructor's cost. 4. Add indirect overhead percent - 32%. 5. Add 20% to establish non-resident fee. 6. Add cost for specialized equipment or supplies. Special conditions: For classes taught by contract instructors, the indirect overhead is only added to the City's percentage. Excursions 1. Transportation cost divided by the number of participants plus overhead transfer. 2. Add 20% to establish non-resident fee. 3. Add any admission cost, supplies or leadership cost. Additional factors that may be used to determine the class or excursion user fee: The total number of participants in a given activity may generate additional revenue whereby the total program cost may be reduced. Classes that traditionally have waiting lists may have the user fee increased. We are scheduled to hold our monthly Legislative Action Committee meeting on Friday April 6, 2007, so I am respectfully requesting that you postpone this item to allow time to review with our committee and have a better understanding on its impact on current and future businesses here in Cupertino.
