Ordinance 1657 ORDINANCE NO. 1657 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING VARIOUS SECTIONS OF TITLE 19 ZONING CODE REGULATIONS THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES HEREBY ORDAIN THAT THE FOLLOWING CHAPTERS ARE AMENDED AS FOLLOWS: Chapter 19.08: Definitions Child means a person who is under 10 years of age for whom care and supervision are being provided in a day care home or day care facility. Family Day Care Home means a home which regularly provides care, protection, supervision of children in the home, for periods of less than 24 hours a day, while the parents or guardians are away. Provider means a person who operates a child day care home and is licensed by the State of California. Chapter 19.20 - Agricultural-Residential (A-I) zone. 19.20.030 - Permitted Uses H Small Family Day Care Home. L Large Family Day Care Home, which meets the parking criteria contained in Chapter 19.100, and which is at least 300 feet from any other large family day care home. The Director of Community Development or his/her designee shall administratively approve large daycare homes to ensure compliance with the parking and proximity requirements. 19.20.040 - Conditional Uses. (A) Issued by the Planning Director. 5. Large family day care home, which otherwise does not meet the criteria for a permitted use. The conditional use permit shall be processed as provided by Section 1597.46 (3) of the State of California Health and Safety Code. Chapter 19.28 - Single-Family Residential (R-l) zone. 19.28.030 - Permitted Uses J. Large family day care home, which meets the parking criteria contained in Chapter 19.100, and which is at least 300 feet from any other large family day care home. The Director of Community Development or his/her designee shall administratively approve large daycare homes to ensure compliance with the parking and proximity requirements. Large family day care home which meets the parking criteria contained in Chapter 19.100, and which is at least 300 feet from any other large family day care home. The Director of Community Development or his/her designee shall administratively approve large daycare homes to ensure compliance with the parking and proximity requirements. Chapter 19.40.040, Conditional Uses. (A) Issued by the Planning Director. 2. Large family day care home which otherwise does not meet the criteria for a permitted use. The conditional use permit shall be processed as provided by Section 1597.46 (3) of the State of California Health and Safety Code. Chapter 19.44 - Residential Single-Family Cluster (RIC) zone. Chapter 19.44.040, Permitted Uses. C. Small-family day care home Chapter 19.44.050 - Conditional Use Permit. The following uses may be permitted, subject to the securing of a condItional use permit in each separate case, in locations where they, in the opinion of the Director of Community Development, are compatible with existing and planned uses within the development area: A. Large-family day care homes: The conditional use permit shall be processed as provided by Section 1597.46 (3) of the State of California Health and Safety Code. B. Group care activities providing continuous care for six or fewer persons on a twenty-four hour basis which requires licensing by a governmental agency. (Ord. 1601 Exh. A (part), 1992) Chapter 19.100 - Parking and Keeping Vehicles in Various Zones M Large family day care home. A minimum of one parking space per non-resident employee is required. This parking requirement shall be in addition to the minimum requirements of the zoning district. The parking space may be on-street, in front of the provider's residence. A minimum of one parking space shall be available for child drop-off. The space shall provide direct access to the unit, not crossing a street. If the provider is relying on on-street parking and the roadway prohibits on-street parking, a semi-circular driveway may be provided, subject to other provisions of the Municipal Code. Effective Date This Ordinance No. 1657 shall take effect and be in full force 30 days after its enactment.
