Consideration of the Public Safety Commission's request to adopt the Cupertino Health
and Safety Fair as a City-sanctioned event.
BACKGROUND
In keeping with its service objective to "promote public education programs concerning
safety issues," the Cupertino Public Safety Commission wishes to conduct a Health and
Safety Fair that would be held annually on the fourth Saturday of August. The goal of the
fair will be to promote safe and healthy lives for the citizens of Cupertino by identifYing
and providing some of the requisite public safety and health information and education.
The attached letter from the Public Safety Commission details its request that Council
adopt the Health and Safety Fair as a City-sanctioned event.
Among the anticipated fair participants are public safety and health agencies such as the
Santa Clara County Sheriff's Office, medical organizations such as the Lucile Packard
Children's Hospital, City organizations such as the Cupertino Bicycle Pedestrian
Commission, and many others.
The Public Safety Commission's request that Council adopt the Cupertino Health and
Safety Fair as a City-sanctioned event includes the Commission's proposal that Council
approve a modest budget to provide for necessary materials, City staff time, City event
and facility fees, and coverage by the City's insurance. This request, detailed in the
attached letter from the Commission, will be made as a formal budget request by the
Commission during Council's review and approval of the City's 2007-08 budget. The
Public Safety Commission also asks Council for authorization to seek and receive
donations to help defray a portion of the costs of the fair.
Staff recognizes that the Health and Safety Fair represents a worthy and admirable effort
on the part of the Public Safety Commission. However, as a policy matter, the Council is
advised that approval of the Commission's budget request for the fair will set a precedent
in providing a discretionary source of funds for the Commission to expend on an
operational activity.

Since the Commission is an advisory body only, the Council should consider the
appropriateness of funding the activities of a group whose responsibilities are not those of
an operational city unit. Further, in setting that precedent, it may be difficult to refuse
similar budget requests for like activities by any other of the City's many commissions.
Since the Commission reports directly to the Council, their request to adopt the Cupertino
Health and Safety Fair as a City-sanctioned event is submitted by the staff on their behalf
without a recommendation beyond the caution noted above.

Subject: Request ofthe Public Safety Commission for Council Adoption of the
Cupertino Health and Safety Fair as a City-Sanctioned Event
Honorable Mayor and Members of the City Council,
At its regular December 14, meeting, your Public Safety Commission (PSC), on which I
sit, approved the formation of a Safety Fair committee and appointed me committee
chair. The purpose of the committee is to plan, organize, and conduct a safety fair in
Cupertino as an annual event to benefit the citizens of Cupertino. The goal of the fair,
now named the Cupertino Health and Safety Fair, is to promote safe and healthy lives
for the citizens of Cupertino by identifying and providing some of the requisite public
safety and health information and education. This is in keeping with the Commission's
service objective to "promote public education programs concerning safety issues."
On behalf of the Public Safety Commission, I therefore request that the Council adopt the
Cupertino Health and Safety Fair, which is to be held annually on the fourth Saturday in
August, as a City-sanctioned event. As part of this request, the PSC asks that Council
approve a modest budget that will provide for the event's insurance under the City's
existing liability coverage, as well as cover materials, City staff time, and City event and
facility fees. This request will be made as a formal budget request during Council's
review and approval of the City's 2007-08 budget. With Council authorization, we hope
to defray a portion of the costs with donations from event participants and attendees. An
estimate of the necessary event funding is attached.
Last year, in partnership with the Santa Clara County Sheriffs Office, and with the
cooperation of the PSC and City staff, I was able to present a modest version ofthis fair.
Participants included the Lucile Packard Children's Hospital, the Santa Clara County Fire
Department, the County of Santa Clara Public Health Department, American Medical
Response (AMR), Cupertino Bike Shop, the Cupertino Bicycle and Pedestrian
Commission, the Cupertino Teen Commission, and other City organizations, including
CERT, CARES, Medical Reserve Corps, Neighborhood Watch, and Block Leaders. For

the 2007 event, which will fall on August 25, we would like to seek additional partners
such as State Farm, YMCA, EI Camino Hospital, American Heart Association, etc.
Apart from the time contributed by Sheriff, County Fire, and City staffs, the Cupertino
Health and Safety Fair is to be run with time volunteered by members of many Cupertino
organizations.
