Residential Design Review for a 935 square foot, first and second story addition
to an existing residence.
Design Review Committee decision final unless appealed
Continued from the November 20, 2002 meeting.
Staff Presentation: Gary Chao, Assistant Planner, explained that this project was
previously heard at the November 20, 2002 and the Committee decided to continue this
application to the next regularly scheduled meeting. Since the last meeting, the
applicant has worked out the privacy issues with the concerned neighbor. The
neighbor at 10354 Byrne Avenue has signed a privacy waiver with some conditions
agreed upon by both parties. Staff has added a condition stating that the applicant
must meet those privacy conditions. Regarding the color of the home, the applicant is
suggesting to revise the color to a darker gray. Staff would like to suggest that the
Committee add a condition that requires the applicant to revise the front elevation so
that the pitch of the ent~ canopy matches the pitch of the roof and gable. The applicant
is aware of this additional request and agrees. Staff recommends approval based on the
added condition that the front elevation is revised. Mr. Saadati asked what the height
of the entry was. Mr. Chao stated that it is less than 14 feet.

change the exterior color and to revise the front elevation so that the pitch
of the entry canopy to match the pitch of the roof and gable.

Sign Exception to exceed the maximum wall sign height in accordance with
Chapter 17.24 of the Cupertino Municipal Code.
Design Review Committee decision final unless appealed
Staff Presentation: Ciddy Wordell, City Planner, explained that this application needs
sign exception due to the height of the proposed sign and the stacking of the sign
instead of one row. The proposed sign is 4 1/2 feet and the allowed height is 2 feet. If the
sign were to be in one line, the sign would still meet the correct length requirement, but
the applicant has chosen to stack the sign. Staff believes the sign still fits into the look of
the center. The Aaron Bros. sign has already been placed higher in anticipation of
having a stacked sign. Staff recommends approval.

Residential Design Review of a new, two-story residence with a floor area ratio
on a 5,355 square foot parcel.
Design Review Committee decision final unless appealed
Chairperson Auerbach stepped down from discussing this item due to the proximity of
his residence to the applicant's. Commissioner Saadati was the Chairperson and
Commissioner Chen was the alternate Committee member for this item.
Staff Presentation: Peter Gilli, Associate Planner, briefly described the application. Mr.
Gilli explained that most of staff's review was on reducing the impacts of the second
story. The neighborhood is mostly single-story. The applicant has agreed to address
the floor area ratio calculation being incorrect. Regarding privacy protection planting,
the applicant verbally stated that he would like to plan two Cedar trees along the rear
property line. Staff has added a condition stating the applicant plant two 24" box Cedar
trees 5 feet from the rear property line spaced 20 feet apart. The neighbor at the rear
property line had some questions about privacy planting and it was possible that the
applicant revised the protection plan. If so, staff would feel comfortable approving a
plan that both parties agreed upon.
Rob McCready, applicant, stated that he is open to suggestions regarding privacy
protection along the rear property line.
David Chan, 10675 Minette Place, is concerned that the Cedar trees set 5 feet back from
the rear property line might not be far enough for the trees to clear the utilities lines.
Mr. McCready is comfortable selecting another species of tree.
Mr. Gilli suggested that since neither party seems to have an issue with the tree itself,
the condition could be changed stating that privacy protection needs to be provided in
conformance to the code with sensitivity to how fast the tree will grow and impact the
power lines. Mr. McCready suggested Italian Cypress trees. Mr. Chan agreed.
