RESOLUTION OF THE BOARD OP SUPERVISORS OP THE
COUNTY OF SANTA CLARA, STATE OF CALIFORNIA, IN
THE MATTER OF THE INCORPORATION OF THE CITY OF
CUPERTINO.
The Board of Supervisors of the County of Santa Clsma~ State
of California~ do resolve as follows:
WP~REAS, the Board of Supervisors of the County of San~
Clara, meeting in regular session on Monday, the 23d day of May,
1955, received the Petition for the incorporation of the City of
Cupertino, and that thereafter in regular session on Monday, the
13th day of June, 1955, the County Assessor certified to said Board
that the Petition received on May 23, 1955, was sufficient, and
the said Board then directed said Petition to be filed contingent
upon the deposit with said County Clerk of the cost of the publica-
tion of the Petition and Notice of Election; and
WHEREAS, said Board of Supervisors determined at its meeting
of June 13, 1955, that the cost of said publications would amount
to the sum of $425.00; and
WHEREAS, within fifteen days after the order of filing and
determination of the costs by said Board, to-wit; on June 13, 1955,
the said sum of $~25.00 was deposited with the Clerk, and the Clerk
thereupon filed said Petition with this Board; and
WHEREA~, at the meeting of this Board held on Monday, .the 13th
day of June, 1955, the Board fixed the date of hearing said Petition
for Monday, the llth day of ~uly, 1955, at the hour of 2:00'o,clock
P~M. of said day, and directed the Clerk of this Board to cause
said Petition to be published for at least two (2) weeks before
the time of such hearing, together with a notice stating the time
of such hearing, in the SANTA CLARA JOURNAL, a newspaper of general
circulation printed and published in the County of Santa Clara, F
State of Califox-nia; and ~.~/~
WHEREAS; said Petition was published in said SANTA CIARA
JOURNAL in its issues of June 23; 1955 and June 30, 1955; together
with a notice that the hea~lng of said Petition would be had on
the llth day of July, 1955, at 2:00 otclock P.M.; and
W//EREAS, said Petition c~ne on regularly for hearing before
this Board on July 11, 1955, at 2:00 otclock P.M., and such
heaming was adjourned by said Board to ~uly 18, 19~5~ at the hour
of ll:00 olclock A.M.,
NOW, THEREFORE, said Petition coming on for final hea~ing
before this Board, and proof having been adduced by both oral and
written testimony concerning the extent of the proposed boundaries
of the proposed 0ity of Cupertino and concerning the numbe~ of
inhabitants who reside within such boundaries,
IT IS HEREBYRE~OLVED as follows:
That the boundaries of said proposed 0ity of Oupertino are
hereby established and defined by this Board as hereinafter des-
cribed.
IT IS FURTHER ORDERED that this Board has ascertained and
determined that one thousand seven hundred thirteen (1,713)
inhabitants reside within said boundaries, as near as can be
ascertained.
IT IS FURTHER ORDERED that the Notice of an Election to be
held in such territory for the purpose of determining whether the
same shall become incorporated, and to elect officers to fill the
various municipal elective offices prescribed by law for municipal
corporations of the sixth class shall be published for at least
two (2) weeks prior to such election in the SANTA CLARA JOURNAL,
a newspaper of general circulation printed and published within
such boundaries, and shall be posted for a like period in at
least four (4) public places within the ]tm~ts of said boundaries,
to-wit:

One at the telephone pole in front of thc Post Office,
Highway 9 and Call Avenue, Cupertino, California;
One at the telephone pole across from Town and Country ~a~ket,
Highway 9, Cupertino, california;
One on the wooden post in front of Cupertino Hardware
~ighway 9 andStevens Creek Road, Cupertino, California;
One on the ~ooden post at the southwest corner of
Stevens Creek Road and Highway 9, Cupertino, California.
Said election shall be held on the ~day of~.~,
1955. Said election shall be conducted at the time and place, and
by the election officers, and in the manner provided in the special
Notice of Election, which said Notice of Election shall be caused
by the Clerk of this Board tO be published and posted.

NOTICE OF ELECTION
NOTICE IS ~EP~EBY GIVEN that a special election is hereby
called and ordered to be held on the ~_~day of
1955, within the territory hereinafter described, for the purpose
of submitting to the qualified electors therein the proposition
of determining whether or not said territory shall be incorporated
as a municipal corporation of the sixth class, under the name and
style of "City or'Cupertino," pursuant to Division 2, Part I,
Chapter I of the Government Code of the State of California;
The boundaries of said proposed City are hereinafter more
particularly described.
The name of such proposed co~poration is "CITY OF CUPEETIN0,s
and the number of inhabitants ascertained by the Board of Super-
visors of the County of Santa Clara to ~eside therein is 1,713
as near as maybe ascertained.
The special election hereby called and ordered to be held
shall be held and conducted and the votes thereat received and
canvassed, and the returns thereof made, and the results thereof
ascertained, determined and declared, in accordance with the
provisions of the said Government Code and with'.the general
election laws of the State, except that the nomination of officers
shall be done in accordance with the law applicable to the
nomination of officers of cities of the sixth class.
The ballots to be used at said special election shall be
such as may be required to be used thereat, and in additio~ to
any other matter mequired by law to be printed thereon, there
shall appear the following:
"FOR INCORPORATION ( )
AGAINST INCORPORATION ( )"
Also, said ballots shall contain the namse of all persons
nominated to fill tho five (5) elective offices of City Cou~cil-
man, it having been provided in the petition for incorporation
that all city officers except City Councilmen be appointed by
the Oity Council.
Any person who is a qualified elector of said County, ..
enrolled upon the GreatRegister thereof, and who shall have
resided within the limits of such proposed corporation for at
least fifty-four'(54) days next preceding such election, shall
be entitled to vote thereat.
For the purpose of holding said special election, all of
the County election precincts contained within the exterior
boundaries of said proposed City a~e hereby consolidated into
one election precinct; and the persons hereinafter named being
competent and qualified electors of said territox-y and said County,
and of their respective election precincts, are hereby appointed
officers of election as hereinafter designated, to serve in the
election precinct, and said Officers of Election shall conduct
said election and make returns thereof pursuant to law.

20215 Stevens Creek Road, Cupertino, California.
