Greg, as you are aware we have had a very difficult time connecting directly by phone. In an effort to keep this
moving along, I am forwarding you information relative to our interpretation of the building code that would
exempt Sears from adding an elevator to the existing Auto Center. Your immediate attention to this matter is
greatly appreciated as this has been going back and forth for several months.
Below are the code sections which would provide Sears with an exemption with a brief explanation of our

Dear Greg:
The following letter is in response to our discussion on 02.23-03 concerning our exemption from adding an
elevator and a clarification of the cost breakdown for the renovation of the Sears Auto Center in Cupertino.
It is our interpretation that the Auto Center remodel would fall within the provisions of CBC Section 1134B.2
(Exception 1) where as Sears would not be required to add an elevator because an unreasonable hardship is
created. The unreasonable hardship is generated because of the disproportionate cost of the elevator to the cost
of the project. The adjusted construction cost of the Auto Center remodel is $89,424 which does not exceed the
current valuation threshold based on the "ENR US20 Cities" average construction cost index. It is our
understanding that Sears is not required to incorporate a $75,000 elevator into a $89,424 project since Section
11346.2 of the CBC allows for this type of exception under its "20% disproportionality provision."
• Sears has gone to great extents to voluntarily improve the accessibility of all their stores, and this particular
building is no exception. Sears plans to do almost$62,000 of construction to voluntarily improve this building's
accessibility. Below is a list of these improvements and their related costs:
$11,225 (exterior renovations to improve accessible access to public restrooms)
$1,600 (new accessible doors and hardware in the public sales area)
$4,855 (a new accessible cash-wrap in the sales area)
$44,143 (complete restroom remodeling to improve accessibility)
$61,823 =Total cost of Voluntary Accessibility improvements
Based on the items listed above,the original project cost of$151,247 has been adjusted to exclude the Voluntary
Accessibility Improvements of $61,823 which yields an adjusted Total Project Cost of $89,424. It is our
understanding that this adjusted value falls within the limits of the current valuation threshold, and therefore Sears
is not required to add an elevator to the building. For your information, attached to this document is a complete
cost breakdown for the Sears Auto Center.

The following letter is in response to our discussion on 02-23-03 concerning our exemption from adding an
elevator and a clarification of the cost breakdown for the renovation of the Sears Auto Center In Cupertino.
It is our interpretation that the Auto Center remodel would fall within tha�???yr voA ,¢ 011346 2

Sears has gone to great extents to voluntarily improve the accessibility of all their stores, and this particular ( 1
building Is no exception. Sears plans to do almost$62,000 of construction to voluntarily improve this building's `
accessibility. Below is a list of these improvements and their related costs:
$11,225 (exterior renovations to improve accessible access to public restrooms)
$1,600 (new accessible doors and hardware in the public sales area)
$4,855 (a new accessible cash-wrap in the sales area)
$44,143 (complete restroom remodeling to improve accessibility)
$61,823 =Total cost of Voluntary Accessibility improvements
Based on the items listed above, the original project cost of$151,247 has been adjusted to exclude the Voluntary
Accessibility Improvements of $61,823 which yields an adjusted Total Project Cost of $89,424. It is our
understanding that this adjusted value falls within the limits of the current valuation threshold, and therefore Sears
is not required to add an elevator to the building. For your information, attached to this document is a complete
cost breakdown for the Sears Auto Center.
