' BACKGROUND On January 16,2001, the City Council authorized the execution of an agreement with the Santa Clara Valley Water District (SCVWD) for the reconstruction of the bridge on Bollinger Road over Calabazas Creek in order to increase the hydraulic capacity of the Calabazas Creek L channel at the bridge and to widen Bollinger Road for bicycle lanes. The original agreement provides for the design and construction of extensive improvements to the existing bridge that will both enlarge the cross-sectional area of the box culvert to increase its capacity and lengthen the culvert to accommodate the widening of Bollinger Road. The original agreement calls for the City to ::Idmlnlster the project design ~ntCact and for SCVWD to advertise, award and administer the construction contract. , , On May 3~ 2005, the agreement was amended to reflect changes in the scope of the project. Those changes included (a) altering the limits and extent of work in the Calabazas Creek channel in order to better protect and enIiance the riparian habitat upstream of the bridge; (b) modifying the work in the chaDnel to coordinate the project with a long-term flood risk management plan for the reach of Calabazas Creek between Miller Avenue and Wardell Avenue; (c) including a structur~ upgrade of the bridge necessary for widening the bridge; and (d) shifting the project ma'1.1agement responsibilities from the City to SCVWD. On April 4, 2006, the agreement was again amended because, construction of the project had been delayed by requirements of the environmental approval process, by SCVWD's obligations to its own project approval process, and by SCVWD's requireri1ent that extensive redesign and physical modeling of the bridge's complex storm water flow characteristies be undertaken. L The amendment called for SCVWD to pay for the added costs of the extensive hydraulic redesign and modeling The project design contract with Winzler and Kelly was increased to reflect tho,se added costs of $89,325.12 paid by the District, to bring the contract total to 16 -1 $459,225.12. The amendment to the agreement also extended the term of the original agreement, which at that time was on the point of expiring. .-/ After bids were opened on April18t 2007 t a construction contract for the project was awarded on May 8t 2007, to the low bidder ACC West. Construction of the project, which to be undertaken over two Ye8rst commenced on June 18t 2007t and will proceed to Ocrober of this year. It will recommence in April 2008 and is expected to reach ~ Completion in September 2008. Although the original scope of the design con~t with Winzler and Kelly included construction engineering taskst the extra hours spent on project design by Wmzler and Kelly staff due to design changes and considerable extension of the design phase make it necessary to increase the contract amount by $50tOOO.00 in order to complete the construction engineering tasks. FISCAL IMPACT Earlier this yeart Council appropriated $250tOOO.00 in Fiscal Year 2007-08 and $25,000.00 in . Fiscal Year' 2008*09 for this project in Account No. 270-9443 in the adopted Capital Improvements Program. There are' sufficient funds in this account to cover the recommended increase of $50tOOO.00 in the Winzler and Kelly design contract At project completion, the City will be responsible for roughly 21% of the total costs of the project up to the maximmn approved by Council, and the District will be responsible for roughly 79% of the total project costs. . ' STAFF RECOMMENDATION ----- Staff recommends that the City Council adopt Resolution No. 07- nt: Authorizing the Director of Public Works to approve an amendment of the design contract with Wmz1er & Kelly for the reconstruction of the bridge on Bollinger Road over Calabazas Creek in the amount of $50,000.00, for a total contract amount of $509,226.12. WHEREAS, the project to has been significantly delayed by an extensive redesign and physical modeling of the bridge's complex stonn water flow characteristics; and WHEREAS, extra hours spent on project design by Winzler and Kelly staff due to design changes and considerable extension of the design phase for the Reconstruction of the Bridge on Bollinger Road over Calabazas Creek project make it necessary to increase the design contract amount by $50,000.00 in order to complete the construction engineering tasks covered by the contract. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby authorizes tl,e Director of Public Works to approve an amendment of the design contract, with Winzler & Kelly for the reconstruction of the bridge on Bollinger Road over Calabazas Creek in the amount of $50,000.00, for a total contract amount of $509,Z26.12, and take all necessary associated actions, including allocation and expenditure of funds, on behalf of the City of Cuperlino.
