SUBJECT AND ISSUE
Adopt a resolution authorizing the City Manager to enter into a Cooperative Work Agreement
with the California Department of Transportation to extend the life of 2005-06 Bicycle
Transportation Account grant funds in the amount of $300,000.00 for the Mary Avenue Bicycle
Footbridge Project.
BACKGROUND
On February 15,2004, COlmcil authorized the City Manager to execute an agreement with the
California Department of Transportation (Caltrans) that allowed the City to receive $300,000.00
in 2005-2006 State Bicycle Transportation Account (BTA) grant ~ds to comprise a portion of
the local funds ~uired to finance the Mary Avenue Bicycle Footbridge project. At that time,
Staff had projected ~ construction of the bridge would be completed in 2007. The expiration
of the 2005-2006 BTA funds, set by the agreement to occur on June 30, 2008, appeared to be
compatible with the project schedule.
Ho~ever, the current schedule calling for the project to be completed in 2009 makes it necessary
to extend the life of the 2005-2006 BTA funds beyond their current June 30, 2008, expiration. In
order to do this, the City must enter into a Cooperative Work Agreement (CWA) with the
California Department of Transportation. While not a formal signed agreement, the CW A is a
vehicle employed by the California Department of Finance to extend funds that would otherwise
lapse, through commitments from the funded agency and Caltrans to complete the funded work
on a new agreed-upon schedule.
FISCAL IMPACT
Authorizing the City Manager to enter into a CW A for the 2005-2006 BT A funds will allow the
life of the funds to be extended, thereby allowing the funds to remain available for the City's
Mary Avenue Bicycle Footbridge Project.

STAFF RECOMMENDATION
Staff recommends that City Council adopt Resolution No. 07- , authorizing the City
Manager to enter into a Cooperative Work Agreement with the California Department of
Transportation to extend the life of 2005-06 Bicycle Transportation Account grant funds in the
amount of $300,000.00 for the Mary Avenue Bicycle Footbridge Project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING THE CITY MANAGER TO ENTER INTO A COOPERATIVE WORK
AGREEMENT WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION TO
EXTEND THE LIFE OF 2005-2006 BICYCLE TRANSPORT A nON ACCOUNT
GRANT FUNDS FOR THE MARY AVENUE BICYCLE FOOTBRIDGE
WHEREAS, fiscal year 2005-2006 Bicycle Transportation Account grant funds in the
amount of $300,000.00 approved by the California Department of Transportation for the Mary
Avenue BicycIeFootbridge Project are set to expire on June 30, 2008; and
WHEREAS, due to the impact of higher estimated project costs and the ensuing delays
entailed in securing addition funds necessary to complete the project, the schedule for the Mary
Avenue Bicycle Footbridge now projects a project completion date in 2009; and
WHEREAS, in order to extend the life of the 2005-2006 Bicycle Transportation Account
grant funds the City must enter into Cooperative Work Agreement with the California
Department of Transportation;
NOW, THEREFORE, LET IT BE RESOLVED that the City Council of the City of
Cupertino hereby authorizes Director of Public Works to enter into a Cooperative Work
Agreement with the California Department of Transportation to extend the life of the 2005-2006
Bicycle Transportation Account grant funds in the amount of $300,000.00 for the Mary Avenue
Pedestrian Footbridge Project.
