RECOMMENDATION: Staff recommends that the Design Review Committee (DRC) approve the Director's Minor Modification for a relocated rear driveway labeled Revision" A-1" in accordance with the model resolution. BACKGROUND: The applicant Karen Ngo, representing 1200 San Mateo Avenue LLC, had originally requested a Minor Modification of ASA-2006-16 to delete a secondary driveway from an approved parking structure for an office building that is under construction (Exhibit A- 1). Staff requested a continuance of the application to the next DRC hearing date at the request of the applicant and notified the interested, adjacent property owner who did not attend the meeting. The DRC elected to review the application in order to familiarize themselves with the project and requested additional information. DRC took no action and continued the hearing to December 6, 2007. The applicant presented a revised plan with a relocated driveway that was entirely on the applicant's property. Staff indicated that it had no opportunity to review this revised plan and could not respond until the next DRC meeting. At DRC's request, the minutes for the DRC-approval of the parking structure (file no. ASA-2006-16) are presented in Exhibit B-1. DISCUSSION: Staff's main concern with the original modification was the maintenance of a secondary driveway access from the rear exit of the parking structure. Staff felt a driveway was necessary to prevent unnecessary traffic flows across the neighbor's property to the rear. The applicant has addressed staff's concern by relocating the secondary driveway entirely on his property. Planning and Public Works staff have revised the applicant's I-I DIR-2007-33 Karen N go December 6, 2007 Page 2 design and recommends approval of Revision A-I. The design avoids driveway entry / parking conflicts and is 32 feet wide, which is a safer width for two-way vehicle circulation. The design also preserves existing street trees on Mariani Avenue and the onsite parking inventory to that required by the City parking ordinance. Staff has conditioned the approval with two conditions: 1) Applicant shall submit a revised landscape plan and storm drainage/utility plan for the areas affected by the driveway relocation to be approved by the Director of Community Development and Director of Public Works, respectively. 2) Applicant shall submit a traffic circulation signage plan for the garage to be approved by the Director of Public Works. All interested parties and adjacent property owners have been noticed about this hearing. RECOMMENDATION: Staff recommends that the Design Review Committee (DRC) deny the Director's Minor Modification and retain the joint driveway as originally approved by the Design Review Committee. BACKGROUND: The applicant Karen Ngo, representing 1200 San Mateo Avenue LLC, is requesting a Minor Modification of ASA-2006-16 to delete a secondary driveway from an approved parking structure for an office building that is under construction (Exhibit A). On August 15, 2006, the City Council approved a use permit (file no. U-2006-06) for a 3- story office building and parking structure to be located at 10495 North De Anza Boulevard. The use permit approval required ASA approval through the DRC for the final design of the parking structure as its proposed mass and location had negative visual impacts on the adjacent neighboring office building (Mariani Business Center). On September 21, 2006, DRC approved a revised parking garage design that met the general design direction given by the City Council and was supported by the adjacent property owner, Mariani Business Center. The approved design included a 24-foot wide, secondary driveway toward the rear of the parking garage that accesses Mariani Avenue (Exhibit B). Note that the driveway straddles the property line and occupies land owned by 1200 San Mateo Avenue LLC and Mariani Business Center. 1200 San Mateo Avenue LLC has written permission from Mariani Business Center to trespass on its property in order to construct a portion of the driveway on Mariani Business Center land. 1-7 DIR-2007-33 Karen N go November 15, 2007 Page 2 DISCUSSION: The DRC is requested to review and determine whether an approved secondary driveway should be deleted from the previously approved plans for a parking structure, which also affects the orientation of about a half dozen parking stalls. Staff believes this request is being made because of the inability of the adjacent property owners to reach a mutual agreement on private property disagreements. DRC is not reviewing any other aspects of the design of the parking garage, which has been approved by the City and supported by the abutting property owner. In the past, parking and vehicular access easements were recorded against each property (1200 San Mateo Avenue LLC and Mariani Business Center) that require each property owner to maintain vehicle and parking accessibility for the other property owner. In the parking structure design this has been accomplished through the rear garage entrance (labeled "Easement Access") that opens into the Mariani Business Center parking lot after you make a left turn out of the garage. Removing or retaining the secondary driveway will not affect the visual mass of the parking structure; however, staff believes it will have an adverse effect on onsite circulation. The secondary driveway would allow garage users to enter or exit the rear of the structure directly from Mariani Avenue. Removing the driveway, as proposed by the applicant, would force all rear exit users to drive through the Mariani Business Center parking lot, impacting that business, its customers and employees. In their conditions of approval, the Council has requested that the revised plans be approved by the Design Review Committee. Staff member Jung mentioned several different design proposals. The key design element is to have a greater separation between the garage and the neighboring, Mariani Business Center. The applicant has proposed different types of climbing plants to be used as screening around the structure. The access ramp has been redesigned per the City Council's directive to be inside the garage. Chairperson Giefer confirmed the number of parking spaces inside the structure and the way the cars will face inside the parking garage. The applicant stated that feel they have complied with the Council's requests in their redesign. They have reviewed the new plans with their neighbors prior to submittal. The owner of the Mariani Business Center expressed a concern about traffic in the area but said she liked the new parking structure design. The applicant was reminded that the lighting around the site should be pointed down. BACKGROUND: On November 13,2007, the Planning Commission approved a use permit for a day care center/specialized school (Legend Learning Center) proposed in an existing commercial building near the intersection of Stevens Creek Boulevard and Vista A veneue. The Architectural and Site Approval (ASA) application was not acted on because of the absence of design details for the outdoor playground. The Commission was concerned about the appearance of the playground and safety aspects as the playground was proposed at the edge of a parking lot. The ASA was referred to the Design Review Committee for review and approval. DISCUSSION: Play Structure/Equipment: The applicant, Legend Learning Center, plans on relocating and reusing its existing play structure and rubberized play squares (Exhibit A). The structure was measured and found to fit in the proposed playground minus one of the slides. The play squares are a safety surface and can be laid directly on the asphalt. Note that the play platforms are elevated 6-7 feet. From this height there are no views into adjacent residential yards because of intervening trees on the property that will protect privacy (Exhibit B). Playground Fence: The playground will be enclosed by a steel pole fence. As an extra safety measure, the fence posts will be constructed of 3" x 3" dimensioned steel bars set only 6 feet apart in deep concrete footings. Note that the parking stalls are located abutting only one side of the playground.
