SUBJECT AND ISSUE
Adopt a resolution approving.the purchase of property from the San Jose Water Company
for the development of the Rancho Rinconada Park at Sterling Boulevard and Barnhart
Avenue in the amount of $1,500,000 and authorizing the City Manager to negotiate and
execute all necessary documents to complete the acquisition.
BACKGROUND
]n March of 1999, the area known as Rancho Rinconada in the northeastern part of the
City was annexed from the County into the City of Cupertino. Part of the annexation
included good faith commitments by the City to invest in infrastructure to restore to the
greatest extent possible an area that had been deficient for some time. The City has since
invested almost two million dollars in street maintenance and other work including the
San Tomas Aquino trail system. However, even though Wilson Park and Creekside Park
are nearby to the west, there is no public park space directly serving the residents in the
Rancho Rinconada area.
In June of 2007, the Council included funding for the acquisition and development of a
property owned by the San Jose Water Company at the intersection of Sterling Boulevard
and Barnhart Avenue to serve as a neighborhood park for residents of Rancho Rincoriada.
As this property is adjacent to the San Tomas Aquino Trail, it will serve as a convenient
trailhead as well.
In January of 2008, staff had reached a tentative agreement on a price for the property of
$1,500,000, which is consistent with the current market value of the properly as reported
in current appraisals completed by the Water Company and the City. This agreement is
subject to the approval of the City Council and the Water Company Boazd of Directors.
Waxer Company staff has advised that, once the Council has approved the price, they will
recommend approval by the Water Company Board.

FISCAL IMPACT
The adopted 2007-2008 Capital Improvement Program includes $1,000,000 for
acquisition of the Sterling Barnhart Park. A recommendation to increase this funding by
$525,000 for a total of $1,525,000 in included in the mid-year budget adjustments on this
Council Agenda for February 1.9, 2008. The purchase price is $1,500,000 and the
additional $25,000 is to cover any closing costs or other expenses to complete the
transaction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
APPROVING THE PURCHASE OF PROPERTY FROM THE SAN JOSE WATER
COMPANY AT STERLING BOULEVARD AND BARNHART AVENUE AND
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL
NECESSARY DOCUMENTS TO COMPLETE THE ACQUISITION

NOW, THEREFORE, LET IT BE RESOLVED that the City Council of the City of
Cupertino hereby approves the purchase of property from the San Jose Water Company for
the development of the Rancho Rinconada Park at Sterling Boulevard and Barnhart Avenue
in the amount of $1,500,000 and authorizes the City Manager to negotiate .and execute all
necessary documents to complete the acquisition.
