AN ORDINANCE OF THE CITY OF CUPERTINO REPEALING ORDINANCE NO. 002(1)
AND AMENDING ORDINANCE NO. 002 BY ADDING THE CLASSIFICATION "PLANNED
COMMUNITY DISTRICT" (PC-H).
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
SECTION 1: Repealing Clause
Section 1:1: Ordinance No. 002(1) is hereby repealed as of
the effective date of this ordinance.
SECTION 2: Amendment
Section 2:1: Ordinance No. 002 is hereby amended by the
addition of the zoning classification. entitled "Planned Community
District" (PC-H) .
SECTION 3: Establishment
Section 3:1: "PC-H" District may be established on parcels
of land which are suitable for and of sufficient acreage to contain
a planned community for which development plans have been submitted
and approved. The minimum area of a planned community shall be not
less than twenty-five (25) acres.
SECTION 4: Application to Establish "PC-H" District
Section 4:1: Application for the establishment of a PC-H
District shall include a preliminary development plan. Such pre-
liminary plan shall show the community facilities that will be pro-
vided in the district and shall include the following:
a. A map showing:
(1) Topography of the land, contour intervals as
required by the Planning Commission;
(2) Proposed street system and lot design;
(3) Areas proposed to be dedicated or reserved for
parks, parkways, playgrounds, school sites, public
or quasi -public buildings and other such uses;
(4) Areas proposed for commercial (Cl-H) uses, pro-
fessional office (PO-H) uses, light industrial
(M-1-H) uses, off-street parking and residential
uses proposed to be established in the district.
b. Other data and information which may be deemed
necessary by the Planning Commission for proper
consideration of the

SECTION 6: Development Standards
Section 6:1: Building site c.Y a required: Same as required
for the particular uses in the districts in which they are other-
wise permitted.
Section 6:2: Building Height Limit: Same as required for
the particular uses in the districts in which they are otherwise
permitted.
Section 6:3: Front, side and rear yard, and percentage of
site coverage: Same as required for the particular uses in the
districts in which they are otherwise permitted.
Section 6:4: Off-street parking required: Same as required
for the particular uses in the districts in which they are other-
wise permitted.
SECTION 7: Variation of Regulations
Section 7:1: The development standard specified in Section 6
of this ordinance, may be varied when such variance will result in
improved design of the development and will permit desirable
arrangement of structures in relation to parking areas, parks and
parkways, pedestrian walks and other such features, provided that
the overall average density should not exceed sixteen (16) living
units per acre based on gross acreage designated for residential
usage.
SECTION 8• Application for Use Permits & Building -Permits
Section 8:1: Prior to the issuance of a building permit, the
developer or property owner shall submit an application to the
Planning Commission for a use permit. Such application shall
include the following:
a. Plot plan showing location of building or buildings.
b. Tree planting and landscaping plan.
e. Plans and elevations of buildings to be constructed.
Section 8:2: All use permits, exceptions and variances
granted under this ordinance shall bo reviewed and approved by the

City Council prior to the issuance of a building permit.
SECTION 9: Architectural and Site Approval
Section 9:1: All site layouts and landscaping are subject to the
provisions of Ordinance No. 002(f) of the City.
SECTION 10: Development Standards for Streets, Private Ways, Building
Sites and Storm Drainage
Section 10:1: The standards heretofore established in the sub-
division ordinance and the site control ordinance of the City shall
apply in all cases, subject to the provisions of Section 7 of this
ordinance.
SECTION 11: Severability Clause
Section 11:1: If any section, subsection, sentence, clause or
phrase of this ordinance is for any reason held to be unconstitutional,
such decision shall not effect the validity of the remaining portions
of this ordinance. The legislative body hereby declares that it
would have enacted this ordinance and each section, subsection, sen-
tence, clause or phrase thereof, irrespective of the fact that any
one or more sections, subsections, sentences, clauses or phrases be
declared unconstitutional.
SECTION 12: Publishing Clause
Section 12:1: The City Clerk is hereby uALhortzed and directed
to cause a certified copy of this ordinance to be published at least
once within fifteen (15) days after its enactment in the Cupertino
Courier, the official newspaper of the City, published. and circulated
within the City of Cupertino.
INTRODUCED at a regular meeting of the City Council on the
7th day of January, 1963; and ENACTED at a regular meeting of
the City Council of the City of Cupertino, this 21st day of
January, 1963, by the following vote:
