CC Ordinance No. 1179• ORDINANCE NO. 1179 AN ORDINANCE OF THE CITY OF CUPERTINO PROVIDING FOR PENALTIES FOR ORDINANCE VIOLATIONS Section 1. - Amendment Section 1.12.010 of the Cupertino Municipal Code is hereby amended to read as follows: 1.12.010 - Violation of Code. it shall be unlawful for. any person to perform any act that is prohibited, made or declared to be unlawful or an offense by the code, or to violate any pro- vision or fail to comply with any of the requirements of this' code. A violation of any of the provisions or failing to comply with any of the mandatory requirements of the code shall constitute an infraction except: 1) When the violation of a provision of this code is specifically declared to be a misdemeanor, or 2) When the violation is the fourth or more violation, within one year, of ,the same ordinance otherwise deemed to be an infraction in which case said fourth or more violation shall constitute a mis- demeanor. Unless otherwise specified by this code, an infraction is punishable by (1)•a fine not to exceed fifty dollars ($50) for a first violation, (2] a fine not exceeding one hundred dollars ($100) for a second violation of the same chapter of this code within one year and (3j a fine not exceeding two hundred fifty dollars ($250) for a third violation of the same chapter of this code within one year. within fifteen ~5) days after its enactm~t in the Cupertino Courier, the official newspaper of the City, published and circulated within the City of Cupertino. Section 5. - Repealed. .
