AREA DETACHED FROM THE CITY OF SAN JOSE AND ANNEXED INTO
THE CITY OF CUPERTI NO IN JULY 1979, ENCOMPASSING APPROX-
IMATELY 3,500 HOMES
THE CLTY COUNCIL OF TH E CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on September 13, 1982, an application was filed by the
City of Cupertino (Applicat ion 13-Z-82) for the rezoning of property
from various City of San Jo se zoning districts to comparable City of
Cupertino zoning districts a s follows:

appropriate by the Planning Commission and/or City Council. The area
proposed to be rezoned includes that area detached from the City of San
Jose and annexed into the City of Cupertino in July 1919. The area encompasses
approximately 3,500 homes and is generally located as follows:

South of Phil Lane and Clifford Drive
West of Carver Drive and Tantau Avenue

North of Rainbow Drive and Prospect Road
East of Wilkinson Avenue and Bubb Road

West of Saratoga-Sunnyvale Road
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted;
and
Wl1EREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of
Cupertino.

NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be
and hereby is rezoned from various City of San Jose. zoning districts
to comparable City of Cupertino zoning districts; subject to conditions
listed in attached Exhibit "C", and that Exhibit "B" attached hereto is
made part of the Master Zoning Map of the City of Cupertino.
Section 2. Thies ordinance shall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this 1st day of November .1982 and ENACTED at a regular
meeting of the City Council of the City of Cupertino this ~~ day of

1. Buildings or uses legally established prior to annexation to the
City of Cupertino 1n July of 1979 may remain per the provisions
of the City of Cupertino's Non-Conforming Use Ordinance. Additions,
modifications or changes in use shall require use permit approval
Erom the City of Cupertino Planning Commission and/or City Council.
CONDITIONS APPLICABLE TO PROPERTIES ZONED P (PLANNED DEVELOPMENT WITH
RESIDENTIAL DUPLEX INTENT)
1. Buildings or uses legally established prior to annexation to the
City of Cupertino in July of 1979 may remain per the provisions of the
City of Cupertino`s Non-Conforming Use Ordinance. Additions. modifica-
tions or changes in use shall require use permit approval from the
City of Cupertino Planning Commission and/or City Council.
2. Density levels shall not exceed thosa levels permitted by the Cupertino
General Plan.
3. Use Permit approval shall be required Eor any significant modifications
or changes in use as determined by the Director of P~ai.aing and
Development.
