AN ORDINANCE OF THE CITY OF CUPERTINO, AMENDING ORDINANCES 220(k) NO. 002 AND 220; REGULATING LIGHT INDUSTRIAL (ML) ZONES. Section THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: 107 AMENDMENT 107.1 Ordinances No. 002 and 220 of the City of Cupertino, California, are hereby amended by adding Sections 107 through 123, as stated in this extension (k) of Ordinance No. 220; by amending Ordinance 220(f) , Appendix A, by changing the Standard Symbols "ML" to "ML-10", "MP" to "MP-43" and "OP" to "OP-43"; and by deleting Section 90.2 from Ordinance 220 (j) . 107.2 This Ordinance 220(k) replaces the provision in Ordinance 002 Section 2 of the City of Cupertino which applies the Zoning Ordinance of the County of Santa Clara to the City of Cupertino; except that the general provisions and exceptions in Sections 29 and 30 and other applicable provisions of said County Ord- Sinance shall continue to be applied to the City of Cupertino in cases where there are no specific provisions in City Ordinances. 108 PURPOSE 108.1 This amendment to Ordinances 002 and 220 provides separate Cupertino regulations for Light Industrial (ML) Zones which heretofore have been regulated by Ordinance NS-1200 of the County of Santa Clara, as it was in effect on October 10, 1955. 109 INTERIM NATURE OF AMENDMENT 109.1 The entire Zoning Ordinance is being studied and subjected to public hearings. It is understood that the regulations contained in this Amendment to Ordinances 002 and 220 may be changed when later made a part of the entire revised Zoning Ordinance for the City of Cupertino. 110 APPLICATION 110.1 No building, structure or land shall be used, and no building or structure shall be hereafter erected, structurally altered or en- larged in a Light Industrial (ML) Zone, otherwise than in conformance with the following provisions; except that uses, buildings and structures lawfully in existence at the time this Ordinance 220(k) takes effect may remain as long as no alterations take place. 410 k (1-113) -1- AL 81,040. 3 October 13 , 1969 220(k) LIGHT INDUSTRIAL (ML) ORDINANCE (continued) 111 INTENT 111.1 Light Industrial (ML) Zones are intended to provide for certain "heavy" commercial and "light" industrial uses. Such uses are generally incompatible with retail and central business district areas but perform important storage, manufacturing, or servicing functions for such uses and for the residential areas of the City. Light Industrial uses are allowed because of the need for sites for small industries, and because the characteristics of the permitted industrial uses are likely to be similar to the per- mitted commercial uses. The uses permitted in this zone often create some objectionable influence such as noise and large volumes of truck traffic, but are essential uses in the urban economy. The lands in this zone should be located near central business areas, near arterial traffic routes, along railroad lines, or where specialized services for the residential community should be grouped. 112 USES PERMITTED WITHOUT SECURING OF A USE PERMIT 112.1 Basic permitted uses: a. Manufacturing, processing, assemhly, research and development factories, laboratiories, shops, facilities and uses which are of the character that they, in the opinion of the Planning Commission, can be reasonably controlled to confine the effects of glare, noise, dust or any other emissions and radiations within the premises. b. Automobile, trailer, tire and boat sales, rentals, service, repair and storage, including body and upholstery shops, but limited to new and used vehicles in operable condition and new, reconditioned and used parts, if stored inside a building; except that accessory gasoline and diesel fuel pumps and com- mercial car washing facilities shall be subject to the securing of a Use Permit. c. Commercial parking lots and parking garages, trucking and bus terminals and garages; except that accessory gasoline and diesel fuel pumps and commercial car washing facilities shall be subject to the securing of a Use Permit. d. Warehouses, including storage of furniture and household goods. e. Wholesale and storage within completely enclosed buildings; excluding petroleum products. f. Packing and crating establishments. g. Auction houses, used furniture sales, feed sales, cold storage facilities, including frozen food lockers. h. Home, garden and farm equipment and appliance sales and rentals. i. Dry cleaning plants and similar establishments; provided that the solvents used in the cleaning process shall be nonflammable and noexplosive and are in fluid-tight cleaning units approved by the State Fire Marshal. n. Animal clinics and hospitals; facilities for bathing, clipping, trimming and similar services for pets ("Poodle Parlors") ; kennels, taxidermists. o. Television, radio and motion picture studios and stations. p. Public utility facilities and service yards and associated buildings; communications equipment buildings; corporation, contractors and plumbers shops, storage and yards. 112.2 All uses permitted in a General Commercial (CG) Zone without the securing of a Use Permit are permitted in an ML Zone; provided that they are auxiliary or subsidiary to or an essential part of an established operation or use permitted by Sections 112 and 113 of this Ordinance 220(k) . Such auxiliary uses shall include personal services, retail establishments and recreation facilities, located on the same lot as the principal use, and exclusively for the convenience of persons employed in or customers of the principal use. 112.3 The above Section 112.2 notwithstanding, the following uses are permitted as independent operations: a. Stenographic and duplicating services; messenger and telegraph offices. b. Delivery services; janitorial services. 112.4 Residence for occupancy by caretakers or watchmen employed for protection of the principal permitted use will be permitted when located on the lot occupied by the principal use. 112.5 Signs conforming with the Sign Ordinance (No. 353) of the City of Cupertino are permitted in an ML Zone. 112.6 Other uses which, in the opinion of the Planning Commission, are consistent with the character of an ML Zone; are of the same general character as the uses listed in the above Section 112.1 of this Ordinance 220(k) ; and do not exceed the levels of odor, dust, smoke, glare, fumes , radiation, vibration, or noise stated in Section 115 of this Ordinance 220(k) , may be permitted in an ML Zone. ti (1-115) -3- AL 81,040. 3 220(k) LIGHT INDUSTRIAL (ML) ORDINANCE (continued) October 15, 19d9 --------------------------------------------------------------------------------- 113 USES PERMITTED, SUBJECT TO THE SECURING OF A USE PERMIT 113.1 The following uses may be permitted, subject to the securing of a Use Permit in each separate case, in locations where they, in the opinion of the Planning Commission, are compatible with existing or planned uses in the neighborhood : a. Swim clubs, swim schools, and commercial swim pools. e. Retail sales of mixed concrete sold in batches not exceeding one cubic yard. f. Stone cutting, monument manufacture. g. Mortuaries. h. Heliports as accessory uses. i. Manufacture of radioactive material, provided that emissions do not exceed permissible levels, as substantiated through inspection by the Atomic Energy Commission. 113.2 Other uses which, in the opinion of the Planning Commission, are consistent with the character of an ML Zone; are of the same general character as the uses listed in the above Section 113.1, and do not exceed the levels of odor, dust, smoke, glare, fumes, radiation, vibration or noise stated in Section 115 of this Ordinance 220(k) , may be permitted in an ML Zone; subject to the securing of a Use Permit. 114 EXCLUDED USES 114.1 The following uses shall not be permitted in ML Zones : a. Bag cleaning; blast furnace; boiler or tank works; candle factory; cannery; central mixing plant for cement, mortar, plaster or paving Materials; coke oven; curing, tanning or storage of raw hides of skins; distillation of bones, coal or wood; distillation of tar; drilling for oil, gas or other hydrocarbon substances; dumping, disposal, incineration or reduction of garbage, sewage, offal, dead animals or refuse; fat rendering; forge plant; foundry or metal fabrication plant; hog farms; junk yard or the baling of rags or junk; pumping refining or wholesale storage of crude petroleum; slaughtering of animals; smelting of copper, iron, tin, zinc, or other ores; steam power plant; stock yard; stone mill or quarry; sugar refining; wool pulling or scouring. Commercial excavating of building or construction materials. 114.2 Uses not specified in this Ordinance 220(k) which, in the opinion of the Planning Commission, are similar to those listed in the above Section 114.1, or would impose hazard to life or property in the neighborhood, shall be excluded from ML Zones. 115 PERFORMANCE STANDARDS IN RELATION TO EMISSIONS 115.1 Emissions of noise, vibration, radiation, light, smoke, fumes or gas, odor, dust, and toxic waste shall be limited to quantities indicated in this Section 115. The limitations shall apply at any point outside the boundary of each lot in an ML Zone; the boundary assumed, for the purpose of this Ordinance, to extend in a vertical plane above and below ground. The intensity of light at the boundary of an industrial zone, or an industrial area in a Planned Development (P) zone, shall not exceed fifty (50) foot-Lamberts from a source of direct light, or seventy-five (75) foot-Lamberts from a source of reflected light. e. Smoke: No emission shall be permitted, from any chimney or otherwise, of visible grey smoke of a shade equal to or darker than No. 1 on the Power's Micro-Ringelmann Chart, published by McGraw-Hill Publishing Company, Inc. and copyrighted in 1954 (being a direct facsimile reproduction of a standard Ringel- mann Chart as issued by the United States Bureau of Mines) ; except that a visible grey smoke of a shade equal to No. 2 on such a chart may be emitted for four (4) minutes in any thirty (30) minutes. f. Fumes and Gas : Any toxic or irritating ingredients in emitted fumes or gas shall not exceed ten percent (10%) of the concen- tration indicated in "General Safety Order" issued by State of California, Department of Industrial Relations, Division of Industrial. Safety (Reprinted January, 1964) . Collection of heavy gases at ground level shall be prevented. g. Odor: No emission of odorous gases or other odorous matter shall be permitted in such quantities as to be readily detect- able when diluted in the ratio of one volume of odorous air of liquid or solid matter to two volumes of clean air. Any process which may involve the creation or emission of any odors shall be provided with a secondary safeguard system so that control will be maintained if the primary safeguard system should fail. There is hereby established as a guide in deter- mining such quantities of offensive odors: Table III "Odors Thresholds", in Chapter 5 of "Air Pollution Abatement Manual", copyrighted in 1951 by Manufacturing Chemists Association, Inc. , Washington, D.C. h. Dust and other Solid Particles: No emission shall be permitted which can cause any damage to health, animals,vegetation or other forms of property. No emission shall be permitted in excess of fifty percent (50%) of the standards specified in Table I, Chapter 5 of "Industrial Hygiene Standards, Maximum Allowable Concentrations" of the "Air Pollution Abatement Manual", copyrighted in 1951 by Manufacturing Chemists Assoc- iation Inc. , Washington, D.C. In no event shall any emission, from any chimney or otherwise, exceed one-tenth of a grain (0.1 grain) per cubic foot of the conveying gas. For measurement of the amount of particles in gases resulting from combustion, standard corrections shall be applied to a stack temperature of five hundred degrees Fahrenheit (500°F) and fifty percent (50%) excess air. Wastes: No discharge into any public sewer, private sewage (cont'd) disposal system, or stream, or into the ground, of any materials of such nature or temperature as can contaminate any water supply, interfere with bacterial processes in sewage treatment, corrode or otherwise damage sewers or pipe-lines, or otherwise cause the emission of dangerous or offensive elements, shall be permitted, except in accord with standards approved by the California department of Public Health or other such govern- mental agency as shall have jurisdiction of such activities. In addition, solid, liquid or gaseous toxic wastes shall not exceed ten percent (10%) of the concentration indicated in the "General Industry Safety Order" issued by State of California, Department of Industrial Relations, Division of Industrial Safety. Where a rear yard is required or provided it shall be at least twenty (20) ft. deep; except for the provisions in Sec- tion 118.4 of this Ordinance 220(k) . 118.4 Where a lot in a Light Industrial (ML) Zone is adjacent to or separated by a street from an area zoned Residential (R) or Agricultural- Residential (Al) , yards shall be at least fifty (50) ft. deep. Twenty- five (25) ft. of any such yard nearest the lot lines shall be used and maintained only as a landscaped planting or screening strip (except for accessways) on which shall be placed hedges, evergreens, or other suitable planting or screening materials. The remainder of such yard space may be used only for off-street parking, or else the remaining yard space shall be maintained as a landscaped planting strip in the same manner as the first 25 ft. 118.5 No part higher than twenty (20) feet of a building shall be closer to a lot line than one half of its height. 119 PARKING AND LOADING 119.1 As provided in the Parking Ordinance, 002(q) , of the City of Cupertino. 120 DENSITY OF EMPLOYMENT 120.1 Recognizing that a high density of employment may create traffic volumes that exceed the capacity of the street system, the following procedure shall apply: Where the number of parking spaces provided exceed one per five hundred (500) square feet total lot area, the use shall be subject to a specific written approval by the Director of Public Works. Before issuing such approval the Director shall study the effect on the City's street system of the traffic generated by the subject use, and the approval shall state that ensuing problems have been solved or will be solved with the participation of the app- licant. Denial or other decision by the Director of Public Works may be appealed to the City Council. 121 EXCEPTION 121.1 West Valley Industrial Park, which has been rezoned to ML-re by Ordinance 384 of the City of Cupertino, shall be excluded from the provisions of this Ordinance 220(k) , and shall be regulated by the provisions in Resolution 406 (as amended by Resolution 409) and Resolution 476 of the Planning Commission of the City of Cupertino. 122 SEVERABILITY CLAUSE 122. 1 If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance.
