ORDINANCE NQ. 857
AN ORDINANCE OF THE CITY OP CUPERTINO AMENDING SECTION 1
OF ORDINANCE 'N0. 2 BY RE20NING APPRUXIMATELY ONE ACRE
FROH R3 ZONE AND R1-IO ZONE TO P ZONE; LOCATED ADJACENT
TO AND EASTERLY OF BLANEY AVENUE APPRORIMATELY 115 FT.
SOUTHERLY OF THE INTERSECTION OF STEVENS CREEK BOULEVARD
AND BLANEY AVENUE
THE CITY COUNCIL OF THE CITY OF CiJPERT2N0 DOES ORDAIN AS FOLLOWS:

i WEiEREAS, on June 30. 1971, an application was filed by Brenda Williams
(Application 1$-Z-77) for the rezoning of property from R3 (Reaidential;mul-
tiple) Zone and R1-10 (Reaidential, single-family, 10,000 sq. ft. par dwelling
unit) Zone to P'(Planned Development with residential cluater intent) Zone;
and
WHEREAS, upon due aotice and after one public hearing the Planning Com-
mission recoummended to the City Council that the Rezoniag be granted; and
WHEREAS, che propertq to be rezoned is presently in an R3 (Residential,~
multiple) Zoae and an R1-10 (Reaidentlal, aingle-family, 10,000 sq. ft. per
dwelling unit) Zone; and
WFiEREAS, a map of the subject property is attached hereto as Exhibit •
"B" as a proposad amendment to the Master 2oning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached E~ibit "A" be and
' hereby is rezoned to a P(Planned Development vith reaidencial cluster intent)
Zone, subject to conditions liaced in attached Exhibit "C"; and that Exhibit
"B" atcached hereto is made par[ of the Master Zoning Map of the City of Cuper-
tino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of Cuper-
tino this qrri day of Januaro , 1978, and ENACTED at a regular meeting
of the City Council of the City of Cupercino thisl6th day of January .;978,

16. The land use intensity shall be liaited to an intenaity thae will not
generate more than 16 one-way tripa per acre during the peak traffic

17. TAe applicant shall provide a tree preaervation plan at the Architec-
Cural and Site Approval Co~ittee atage illustrating the trees to be
removed and the methods to be used to preserve the remaining treea
duriag and after constructioa.
18. The viadow location for the two-story bedroom windowa on the unit located
in the southeast corner of the site shall be located to face in an
easterly direction and utilize Wing walls to minimize the degree of
privacy intrusion into the rear yarda of tha adjoining residentlal
neighborhood. Additionally~ the windov location and wing wall acreens
shall be located in the remaining units to minimize the degree of
visual intrusion into the private rear yard space of the on-site units.
The Architectural and Site Approval Co~ittee shall have the ability to
modify window design or location to ensure the optimum protection of
private rear yard space.
19. The applicant shall provide an acoustical study evaluating conformity
of the proposed project with Title 25 of the California Administrative
Code regulating noise insulation standards. The study shall go beyond
