AN ORDLNANCE OF TfiE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY RE20NING APPROXIMATELY ONE ACRE
FROM CG TO P ZONE. LOCATED ON THE NORTFi SIDE OF STEVENS ,
CREEK BOULEVARD APPRO%I!lATELY 100 FT. WESTERLY OF VISTA
DRIVE
THE CIT7f COUNCII. OF Tf~ CITY OF CUPERTINO DOES ORDAIN AS FOLLOHS:
WHEREAS. on Auguat 4~ 1518, an application Was filed by Staffield/Roae
Real Estate Iaveatments (Applicatioa 17-Z-78) for the rezoning of property from
CG (General Commercial) to P(Planned Develop~nt with General Commercial and
Office Uae Intent) Zone; and
WHEREAS, upon due notice~and after one public heariag the Planning Com-
mission recommended to the City Council tnat the Rezoning be granted; and
WliEREAS. the propertq to be rezoned is presently in a CG (General Commer-
cial) Zone; and •
WfiEREAS, a map of the subject property is attached hereto as Exhihit
"B" as a proposed amendment to the blaster Zoning Diap of the City of Cupertino.
vOW, THEREFORE. BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described ia attached Fachibit "A" be aad
hereby is rezoned to a P(Planped Development vith Geaeral Co~ezcial and Office
Use Inteat) Zona, subject to conditions liated ia attached Exhibit "C"; and that
Exhibit "B" attached hereto ie made pazt of the Has[er Zoning Hap of the City
of Cupertino. ~
Section 2. Thia ordiaance ahall take effect and be in force thirty (30) I
daya after its passage. ~

' established by instrument dated April 14, 1961 and recorded Hay 10,
1961 in Book 5163 of Official Records, page 249, from Jack R. Lyddon,
to the City of Cupertino, a municipal corporation, at the Southeasterly
corner of that certain parcel of land as described in the Deed from
J. B. Kerley, D.C. Couch, and W. E. French, Trustees of Joe Kerley Linco.
Mercury, Inc., Profit Sharing Trust, to Oliver n. Scott, et ux, dated
July 9, 1965 and recorded July 14, 1965 in 8ook 7029 of Official Record:
page 133, Santa C2ara Coun.ry Records; thence from said point of beginnin
and along the Northerly line of said Stevens Creek Boulevard, North 89°
41' East 100.00 feet to a point; thence leaving last said line and
parallel withthe Easterly line of said land deeded to Oliver D. Scott,
et ux, North 0° 18' West 160.00 feet to a point; thence parallel r+ith
the Northerly line of said Stevens Creek Houlevard, North'89° 41' East
152.29 feet to a point; thence North 0° 18' West 100.00'feet to a point;

15. That the approval is based upon Eahibit A of Application 17-2-78 as
may he modified by additional conditiona contained herein.
The site plan exhibit ahall zeflect an ingress/egress drive along the
easterly property line off of Stevena Creek Boulevard and ahall incor-
porate a 50 ft. landacaping setback from curb aloag the Stevens Creel;
Boulevard frontage. Tha maximum building area shall not exceed 10,000
, sq. ft. and the allowable uses shall be limited to general retail and
office uses and an emergency medical facility.
