A RESOLUTION DETERMINING THAT THE PUBLIC ~

II~TEREST AND NECESSITY REQUIRE THE ACRUISITION
OF CERTAIN LAND AND DIRECTING THE FILING OF
EMINENT DOMAIN PROCEEDINGS AND APPOINTING
SPECIAL COUNSEL
AESOLVED, by the City Council of the City of Cupertino,
Calffornia, that, ~
WF~REAS, it is the intention of this City Council to ~
construct and maintain streets and street improvements and off-
street motor vehicle parking facilities in and on the land herein- ~
after described, j

NOW, TI~REFORE, IT IS FOUND, DETERMINED and ORDERED as ~
follows:
1. That the pubZic interest and necessity reauire the
acouisition, construction and completion of streets and street ~
I
~improvements and off-street motor vehicle parkin~ facilities ::nd ;

work auxiliary thereto, in, over, a.eross and upon the parce~ of i
r

land more particularly described in Exhibits "A" and "A-1", '

attacned hereto and by this reference made a part hereof, v:itnin `

said city, and the taking of the fee simple title in and to Lhe ;

parcels of land more particularly described in Exhibit "A" afores~ir~
for street purpases, and the taking of the fee simple title in and
to the parce].s of land more particularly described in Exhibit "A-1"!

aforesaid for off-street motor vehicle parking facilities, are ~

necessary for said improvements. ~
2. That said proposed acquisitions and improvements are ~

planned and located in the manner which will be most conp~tible 1
witn the reatest ublic ood and the least ~

all of said acauisitions are situate in the City of Cupertino, ;
County of Santa Clara, State of Ca2ifornia. ~
3. That the law Firm of 47ilson, Jones, Morton & Lynch `
and Sam J. Anderson, City Attorney of the City of Cupertino, ~

conclusion an action in eminent domain for the accuisition of the I

Lynch shall be paid a reasonable fee therefor.
~ That an Order for Iaunediate Possession and Use be

iootained in said action, and that a warrant be issued to the
' County Clerk, Santa Clara County, California, in the amount
determined by the Court to be so deposited,as a condition to the
right of immediate possession.
