A RESOLUTION OF PRELIMINARY DETERMINATION UNDIIt
DNISION 4 OF THE STREEPS AND HIGHWAYS CODE
DeANZA ET AL. IMPROVEMENT PROJECT
PROJECT N0. 6E-1
RESOLVED, by the City ~ouncil of the City of Cupertino,
California, as follows:
1. That the public interest, convenience and necessity
require, and that it is the intention of this Council to under-
take certain acquisitions and improvements within said City and
to assess the cost thereof on lands benefited thereby, said
acquisitions and improvements being described in Exhibit "A"
hereto attached and incorp~rated herein by reference.
2. Reference is hereby made to the map or plat showing
the general nature, location and extent of said acquisitions and
improvements for a further description of said work and for all
particulars relating thereto, which ma.p or plat is on file in the
office of the City Clerk and open to public inspection.
3. Said Council proposes to contribute towards the cost
of said acquisitions and improve:nents the cost of the center two
lanes and center islands and excess acquisition costs in Stevens
Creek Boulevard, traffic signals at Stevens Creek Boulevard and
Stelling Road; and one half of the cost of traffic signals at
Maxy Avenue and Stevens Creek Boulevard and to assess the balance
of the costs of said acquisitions and improvements and the
expenses incidental thereto upon the district benefited thereby,
the exterior boundaries of which axe the coterminous exterior
boundaries of the composite and consolidated area shown on a map
thereof on file in the office of the City Clerk to which reference
is hereby ma.de for further particulars; which map indicates by a
boundary line the extent of the territory included within the

assessment district and which shall govern for all details as to
the extent of said proposed district; provided, however, that all
of the cost of the acquisitions and impr~vements described in
subparagraphs (d), (e) and (f) of the attached description of
work, together with all incidental expenses thereof, shall be
assessed solely against the properties of the Foothill Junior
College District.
4. That proceedings for said acquisitions and improvements
shall be conducted pursuant to Division 4 of the Streets and
Highways Code (the Special Assessment Investigation, Limitation
and Ma~ority Protest Act of 1931) and the Municipal Lnprovenent
Act of 1913, and bonds shall be issued pursuant to the Improvement
Bond Act of 1915.

STEVENS CREEK BOULEVA.RD - STELLING ROAD - McCLELI~AN ROAD
IMPROVEI~NT PROJECT
a) The acquisition oP easementa necessary to widen Stevens Creek
Boulevard to a uniform Kidth of 120 feet from West Valley Freeway
to near Highxay 9 and the improving thereof by clearing and grub-
bing, grading, subgrade preparation, base pavement and wearing sur-
fa,ce, asphalt feathering, and berms, concrete curbs, gutters,
sidexalks and islands, traffic bars, striping, storm drain pipe,
catch basins, manholes and appurtenances, water ma.ins, valves, hy-
drants, hose bibbs, meter connections and appurtena.nces, electro-
liers, traffic signals and signs.
b) The acquiaition oP easements necessary to widen McClellan Road to
a uniPorm width of 60 feet from a point about 550 feet easterly of
Stelling Road to the West Valley Freeway, except~ng therefrom that
portion of McClellan Road outside the City limits of the City of
Cupertino which is westerly of a point about 550 feet westerly of
Stelling &oad, and the ~nproving thereof by clearing and gnibbing,
grading, subgrade preparation, base pavement and wearing surface,
asphalt feathering, concrete curbs, gutters and sidewalks, traffic
bars, striping, storm drain pipe, catch basins, manholes and appur-
tenances, fire hydrants, electroliers and street signs.
c) The acquisition of easements necessary to widen Stelling Road to a
uniform width of 90 feet from near Alves Drive to near Lilac Way,
excepting thereProm that portion of Stelling Road outside the City
limits of the City of Cupertino which is southerly of a point about
175 feet southerly of McClellan Road, and the improving thereof by
clearing and grubbing, grading, subgrade preparation, topsoil, base
pavement andrearing surface, asphalt feathering, concrete curbs,
gutters and sidexalks, striping, storm drain pipe, catch basins,
manholes and appurtenances, water pipe, hydrants, hose bibbs, meter
connections and appurtena.nces, electroliers, traffic signals and
signs.
d) The Laproving of public easements to be dedicated for fire protec-
tion purposes on the property of the DeAnza Campus of the Foothill
Junior College District, by grading and the construction therein
of base pavement and wearing surface, curbs, gutters, atriping,
traffic bars, signs, storm drain pipe, catch basins, manholes and
appurtena.nces, water mains, valves, hydrants, metering station and
appurtenances, and electraliers, and such other facilities as are
reasonably related to the improving of said rights of way for fire
protection purposes.
e) The acquisition of the parcel of property at the southwesterly cor-
ner of Stevens Creek Boulevard and Stelling Road and the improving
thereof as a public off-street automobile parking lot by grading,
removing trees, bushes and existing structures and the construction
therein of base pavement, wearing surface, curbs, gutters, drainage
facillties, lighting Pacilities, striping, landscaping, and all
auzillary work neceasary to complete the same as ofP-street automo-
bile parking facilities.
P) The a~quisition of the right of use of the sewage disposal facili-
ties oP the Cupertino Sanitary District by payment of connection
charges required by said District for connection to their facilities.
g) The acquisition of all lands and easements and the construction of
all work awciliary to any of the above ar~d necessary to complete
the same.
