RESOLUTION N0, 1573
BEING A RESOLUTION OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF EASEMENT
WHEREAS, WESTERN TITLE GUARANTY COMPANY, Santa Clara County Division,
a California corporation, grantor, has executed a Grant of Easement which
is in good and sufficient form, conveying to the CITY OF CUPERTINO,
grantee, an easement for drainage purposes over the property situate
i.n the City of Cupertino, County of Santa Clara9 State of California,
described as follows:
PARCEL ONE
Beginning at the point of intersection of the centerline of
Shetland Place with the monument line of Linnet Lane9 ~6 feet wide,
as shown on that certain map entitled, "Tract Noe 2623, Serra
Gardens Unit No. 3", recorded in the Office of theCounty Recorder
of Santa Clara County in Book 137 of Maps at page 19; thence along
said monument line of Linnet Lane9 N 0°17'22" W 322.52 feet; thence
s 8g°2~?1.5" E 30.00 feet to a point on the southerly line of a 10.00
foot wide strip of land~granted by Western Title Guaranty Company to
the Cupertino Sanitary District, a copy of which deed was filed for
record in the Office of the Recorder of Santa Clara County in Book
7363, Official Records, at ~a,ges 101 to 10~; thence continuing
S 89°24'15" E along the southerly line of said 10,00 foot wide strip
of land, said line being the northerly line of a 5.00 foot wide strip
of° land, 230.92 feet• thence leaving said northerly line at right
an.gles thereto, s oob35~45" W 5.00 feet to a point on the southerly
line of said 5.00 foot strip and the True Point of Be inning; thence
at right angles along the last said southerly line S~9°24'15" E
13000 feet; thence leaving the last said southerly line at right
angles thereto, S o0~35'~+5'~ W 4.00 feet; thence at right angles and
parallel to said southerly lines N 8g°24?15" W 13.00 feet; thence
at right angles N.OO°35'~5~~ E 4.00 feet to the True Point of Beginning.
PARCEL TWO .
Commencing at a granite monument at the intersection of the center-
line of Wolfe Road with the centerline of Homestead Road, as said Home-
stead Road formerly existed 40.00 feet wide, as said intersection is
shown on that certain Map of Tract No, 1906, Verde Gardens Unit No. 2,
a map of which is filed in Book g8 of Maps at page 36 in the Office of
the Recorder of Santa Clara County; thence from said Point of Beginning
southerly along said centerline of Wolfe Road, S o°35'~+5~~ w 1390.66 feet;
thence leaving said centerline of
Wolfe Road at right angles thereto

whose tangent bears N o°35~45" E, having a radius of 60 feet, through a

radius of 55~+.00 feet throu~h a central angle of ~0°17'38" an arc length

wide public utility easement, recorded in Book 7582 of Official
Records at page 607, Santa Clara County Records and the True Point
of Beginning; thence along said southwesterly line S~+g°o6~37" E ~
135.00 feet; thence leaving said southwesterly line N 62°36f22" W
51.42 feet; thence N~+9°06'37" w 35.00 feet; thence N 35°36?52" W
51.42 feet to the True Point of Beginning.
Containing 0.023 acres, more or less.
Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the purpose of locating, constructing,
repairing, maintaining, or replacing public utilities or appurtenances
thereto9 and for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said public utilities;
there is also granted the right of the use of sufficient land contiguous
to said strip on either or both sides thereof for the purposes of ~
excavation of and deposit of earth and necessary building material
during the time of constructing said public utilities, and any repair
thereof.
The foregoing is sub~ject to the following express conditions:
The Grantee agrees to restore the ground surface and any improve-
~ ments thereon to its original grade or condition.insofar as it is
practicable and reasonable to do so,
NOW9 THEREFORE, IT IS HEREBY RESOLVED, that the City of Cupertino
accept said Grant of Easement so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby
authorized to record said Grant of Easement.
