CC Resolution No. 1582 ~ ~ ~ ~ ~ ~ RESOLUTION N0. 1582 BEING A RESOLUTION OF THE CITY OF CUPERTINO ACCEPTING A GRANT OF EASEMENT WHEREAS, CUPERTINO UNION SCHOOL 1}ISTRICT, grantor, has executed a Grant of Easement which is in good and sufficient form, conveying to the CITY OF CUPERTINO, grantee, an easement for street purposes over the property situate in the City of ~upertino, County of Santa Clara, State of California described as follows: BEGINNING at the point of intersection of the centerline of Hyannisport Drive with the monument line of Ft. Baker Drive as said intersection is shown on that certain tract entitled Tract No. 3422 - Yorktown Unit No. 2, a map of which was filed for record in Book 160 of Maps at pages ~0 and 41, Santa Clara County Records; thence from said POINT OF BEGINNING along said centerline of Hyannisport Drive South 8g~ 50~ 40" East, 201.78 feet; thence leaving said centerline at right angles South 0° 07~ 20" West, 30.00 feet to a point on the Southerly line of said Hyannisport DrTive, the TRUE POINT OF BEGINNING of the parcel herein being described; ther.ce from a tangent which bears North 89° 52' ~+0" West along a curve to the left with a radius of 350.00 feet through a central angle of 25° 07~ 20" for an are length of 153.90 feet; thence along a tangent line South 65° 00~ West, 77.71 feet to a point on the Westerly line of the Lands of the Cupertino Union School District; thence along said Westerly line, North 0° 00~ 25" East, 66.10 feet to the Southerly line of Hyannisport Drive; thence along said So~utherly line South 89° 52~ 40" East, 219.09 feet to the TRLTE POINT OF BEGINNING. Grantor hereby further grants to Grantee the right and privilege to enter upon his lands contiguous to and along the line of said here- inabove described strip for the purpose of locating, constructing, repairing, ma.intaining, or replacing said public utilities or appur- tenances thereto, and for the purpose of doing any necessary or lawful act in connection with the construction or maintenance of said public utilities; ~here is also granted the right of the use of sufficient land contiguous to said strip on either or both sides thereof for the purposes of excavation of and deposit of earth and necessary building material during the time of constructing said public utilities, and any repair thereof. The foregoing is subject to the following express conditions: The grantee agrees to restore the ground surface and any improvements thereon to its original grade or condition insofar as it is practicable and reasonable to do so. ; ~ Res. No. 1582 Page 2 NOW, THEREFORE, IT IS I-IEREBY RESOL,VED, that the City of Cupertino accept said Grant of Easement so tendered; and IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby authorized to record said Grant of Easement.
