CC Resolution No. 3101-12 • RESOLUTION N0. 3101-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON SARATOGA-SUNNYVALE ROAD, STEVENS CREEK BOULEVARD, BANDLEY DRIVE, ALVES DRIVE AND LAZANEO DRIVE IN CONNECTION WITH CROSSROADS ASSESSMENT DISTRICT PROJECT N0. 71-2 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CUPERTINO AS FOLLOWS: WHEREAS, Ordinance Noe 474 establishes a procedure for the creation of underground utility districts and requires as the initial step in such pro- cedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility dis- trict, hereinafter called District, be formed on Saratoga-Sunnyvale Road, Stevens Creek Boulevard, Bandley Drive, Alves Drive and Lazaneo Drive in con- nection with Crossroads Assessment District Project No.71-2; NOW, THEREFORE, BE IT RESOLVED as followsa 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Cupertino on November 6, 1972, at the hour of 7:30 p.m. in the Council Chamber of the City Hall, Cupertino, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be deter- mined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled PROPOSED BOUNDARY UNDERGROUND UTILITY DISTRICT, dated September 15, 1972, which is on file in the office of the City Clerk of the City of Cupertino. - 1 - PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 18th day of Sept ember 1972, by the follow- ing vote: AYES: Councilmen - Irwin, Jackson, Meyers, Sparks, Frolich NOES: Councilmen - None ABSENT: Councilmen - None ATTEST: City Clerk APPROVED: Mayor, City of Cupertino - 2 -
