RESOLUTION N0. 3768
A RESOLUTION OF THE CITY COUNCIL OF THE~CITY OF CUPERTINO
GRANTING A VARIANCE TO CARL E. STOREY FROM SECTION
16.28.010 OF THE FENCE ORDINANCE TO INCREASE THE HEIGHT
OF A PROPOSED FENCE FROM A MAXIMUM OF THREE FEET TO SIX
FEET WITHIN THE FRONT SETBACK LINE; LOCATED AT 22266
DE ANZA CIRCLE
WHEREAS, the applicant has met the burden of proof required to support
his said application; and
, WHEREAS, the Planning Commission, after duly noticed public hearings,
has forwarded its recommendation to the City Council;
NOW, THEREFORE, BE IT RESOLVED that after careful consideration of maps,
facts, exhibits and other evidence submitted in this matter, the application
for the Variance (11-V-74) be and the same is hereby approved, subject to con-
ditions in Planning Commission Resolution No. 1355, attached hereunto as Ex-
hibit "A".
BE IT FURTHER RESOLVED that the report of findings attached hereto is
approved and adopted, and that the City Clerk be and is hereby directed to''
notify the parties affected by this decision.

FURTHL'R FINDINGS: ~
1. The placement of a 6 ft. fence within the front setback of the
proper.ty on De Anza Circle affects the general appeax'ance of the
area and the interests of tlie surrounding property owners which
is contrary to the intent of the ori.ginal development plans for
De Anza Circle.
2. There are alternative solutions for the placement of the fence on
the lot which could achieve the desired results for the applicant's
concern for privacy.
3. The applicant was unable to meet the criteria specified in Ordinance '
002(a) Section 4.2 required for a variance.
