CC Resolution No. 3949 RESOLUTION N0. 3949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO OBJECTING TO DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ~ METHODS OF ADMINISTERING THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 WHEREAS, Congress has stated that one purpose of the Housing and Community Development Act of 1974 is to "further the development of a national urban growth policy by consolidating a number of complex and overlapping programs of financial assistance to communities of varying sizes and needs into a consistent system of Federal aid which provides assistance on an annual basis, with maximum certainty and minimum delay, upon which communities can rely in their planning;" and WHEREAS, the Santa Clara County has entered in Cooperation and Joint Powers Agreements with eight non-entitlement cities to establish eligibility as an Urban County; and WHEREAS, the County and its cities have joined together in a program to co- operatively deliver facilities and services under the Housing and Community Develop- ment Act of 1974; and WHEREAS, the Washington, D.C. Office of Department of Housing and Urban Develop- ment is jeopardizing the substance of our programs by creating great uncertainty and delay in their administration of the Urban County application process, notably, the processing of Urban County Cooperation Agreements; and WHEREAS, HUD has failed to give adequate definite and objective standards for the preparation of Cooperation Agreements prior to the time that said Agreements were required to be submitted to HUD: and WHEREAS, by failing to furnish County with timely, objective standards the Cooperation Agreements were required to be amended subsequently to the time that the Cooperation Agreements had been required to be executed and submitted to HUD; and WHEREAS, HUD has dictated terms in the Cooperation Agreements which related solely to the rights and obligations of the parties thereto rather than to HUD; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino objects to the manner in which the Department of Housing and Urban Development, particularly the Washington, D.C. Office, has processed the Urban County Application under the Housing and Community Development Act of 1974; more particular- ly, the City Council objects to HUD's failure to furnish County with timely, definite and objective standards for the preparation of Cooperation Agreements; the City Council further oUjects to HUD's method of establishing standards and making requirements after the time that the Agreements were required to have been executed and submitted to HUD; ~ BE IT FURTAER RESOLVED, that the City Council forward this resolution and accompanying material to the Secretary of the Department of Housing and Urban Development, California Senators, and the Congressional delegation serving Santa Clara County and requests a more fair administration of the Urban County provisions of the Housing and Community Development Act of 1974.
