RESOLUTION N0. 4228
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
~ MAKING ITS ORDER DESCRIBING THE BOUNDARIES DESIGNATED AS
"MEASUREX 76-2" TO BE ANNEXED TO THE CITY AND ORDERING
ANNEXATIONS TO THE CITY WITHOUT PUBLIC HEARING AS PRO-
VIDED BY LAW; APPROXIMATELY .303 ACRES, LOCATED ALONG
IMPERIAL AVENUE BETWEEN LOMITA AVENUE AND OLIVE AVENUE
WHEREAS, pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, proceedings have been initiated by the City Council,
at the request of all the owners of the real property situate in the property
hereinafter described, on its own motion to annex to the City all of that
uninhabited territory situate in the County of Santa Clara, State of California
hereby designated as "Measurex 76-2"; and
WHEREAS, the Santa Clara County Local Agency Formation Commission, by
Resolution No. 76-77 adopted the 7th day of Apri1,~1976, has authorized the
City of Cupertino to annex the territory described in Exhibit "A" and as shown
on the map in Exhibit "B", designated as ''Measurex 76-2", without notice,
hearing or election in accordance with the District Reorganization Act of 1965;
and

WHEREAS, the City Council finds that it is to the best interest of the
City aad of the territory proposed to be annexed that the territory be annexed
~ without public hearing;
NOW, THEREFORE, BE IT RESOLVED that the territory described in Exhibit
"A" and as shown on the map in Exhibit "B", attached hereto and made part
hereof, is hereby annexed to the City of Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 16rh day of A~,g~,~r , 1976, by the following vote:

All that certain real property situate in the County of Santa Clara, State
of California, more particularly described as follows:
Portion of lots lettered E and F in Block 7, as shown upon that certain map
entitled, "Re-subdivision of Subdivision No. 1, Town of Monta Vista", which
map was filed for record in the office of the Recorder of the County of Santa ~
Clara, State of California, on April 11, 1917, in Book "P" of Maps at page
24;
Beginning at the northwest corner of Lot E as shown upon said map, said corner
also shown on that certain Record of Survey, which map was filed for record .
in the office of the Recorder of the County of Santa Clara, State of California,
on July 14, 1959 in Book 108 of Maps at page S0;
Thence S. 0° 00' 30" E., 48.85 feet along the westerly line of said Lot E,
said line also being the westerly line of that~certain parcel of land annexed
to the City of Cupertino entitled "WRIGHT 74-6";
Thence S. 89° 57' 30" E., 130.00 feet along the southerly line of said annexa-
tion "WRIGHT 74-6" to the southeast corner of said annexation, said corner also
lying on a westerly line of that certain annexation tothe City of Cupertino
entitled "MC CLELLAN 1-A";
Thence southerly along the easterly line of said Lot F of said subdivision
map, S. 0° 00' 30" E., 48.85 feet to the southeast corner of said Lot F;
Thence westerly along the northerly line of Olive Avenue and its prolongation
N. 89° 57' 30" W., 200.00 feet to the southeast corner of Lot M in Block 8,
as shown upon said subdivision map, said line also being the northerly line
of that certain parcel of land annexed to the City of Cupertino entitled
"IMPERIAL 71-7; .
Thence N. 0° 00' 30" W., 97.70 feet along the easterly line of said Lot M
to the northeast corner of said Lot M as shown upon said subdivision map;
Thence S. 89° 57' 30" E., 70.00 feet to the point of beginning.
Containing 0.303 acres, more or less.
