CC Resolution No. 4289 ~ RESOLUTION N0. 4289 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING ADDENDUM TO THE SOLID WASTE MANAGEMENT PLAN FOR SANTA CLARA COUNTY WHEREAS, the Solid Waste r4anagement Plan for Santa Clara County has been previously submitted to and approved by the City Council; and WHEREAS, an ~ddendum to said plan regarding a facilities plan and a Solid Waste Planning Committee has been prepared and submitted to the City Council; and WHEREAS, the proposed addendum has been reevaluated for consistency with the previousl.y approved plan and its effect on the local interests of Cupertino; NOW, THEREFORE BE IT RE50LVED that the Cupertino City Council hereby approves the addendum to the Solid Z~aste Management Plan for Santa Clara County, shown as Attachment "A" to this resolution and made part hereof by this referenca. Vaughn, Administrative Assistant II FROM: SUBJECT: ~DENDUM TO THE SOLID WASTE MANAGEMENT PLAN Attached are two addendum changes to the Santa Clara County Solid Waste Management Plan previously approved by the City Council. The purpose of these addendums is to achieve a unanimous ratification by the cities and the county of the plan prepared by Metcalf and Eddy. A unanimous approval has not been obtained because . of the exceptions taken by the cities of San Jose and Mountain View and because of the changes proposed by the Board of Supervisors. However the attached changes have been approved in concept by the Board of Supervisors and it is believed will be approved by the cities of San Jose and Mountain View. The changes are presented as amendments to the original plan because inclusion in the original plan would require recalculation of many cost items and would require a complete reprinting of the plan. Because the Cupertino City Council has previously approved the entire plan as written, a consideration of the two amendment items is all that is r~equired at this time. The proposed amendments affect two areas of the previously approved plan, the placement of the facility sites for processing and transfer stations, and the composition and powers of the Solid Waste Planning.Committee. Regarding facility sites the amendment would retain the original siting recommended in the plan; it would make actual selection of the site subject to review and approval by the af- fected local jurisdictions comprising the appropriate joint powers agency. The effect of this amendment is to remove both Mountain View and San Jose from specifying that the large land fills recommended to be included in their limits are to be constructed irregardless of circumstance on the designated sites. This qualification is recommended as providing the flexibility desired by these cities in specifying land fill locations. As such, the recommended facilities plan has no effect upon the previous analysis made regarding Cuperitno's solid waste requirements and as such is recommended for approval as written. The Solid Waste Planning Committee as originally envisioned consisted of elected representatives only,selected by the Board of Supervisors and the city councils. The alternative recommended in the amendment expands the membership to include representatives of the private sector who would have a voting power on the committee. However, the committee would have the right of decision of weighted voting along the Inter-City Council system or a conventional one-vote system, as it deems best. Quinlan October 19, 1976 agreements, the P.P.C. of Santa Clara County would function as the Solid Waste Planning Committee.. Once again the modification of the Solid Waste Planning Committee is consistent with the position taken earlier by the City regarding the plan, so long as the private sector.does not obtain a disproportionate weight in making recommendations that are matters of public policy. As such the addendum to the plan regarding the Solid Waste Planning Committee is recommended for approval as written. Recommendation ' The addendum modifications to the County Solid Waste Management Plan regarding the facilities location and the composition of the Solid Waste Planning Committee are recommended for approval as submitted and for inclusion as part of the original County plan previously approved. Recommended Facilities Plan. page 11, add a new pa~agraph 2, to read: Sites for future processing plants and landfill for disposal are necessary for the orderly implementation of this Plan. Such srtes must be determined ~ . by a thorough consideration of environmental, geologic, aconomic, social and political factors, and any potenti,al site will be subj.ect to all local ~ regulatory ordinances a~d review procedures, as well as to a varisty of regional and state regulations. This Plan makes use of sane a~sumed loca- tions for facilities in orde~ to develop cost comparisons and materi~l projections~as required by State law. However, they have ~either been thoroughly investigated nor endorsed by any jurisdiction and no a~ssumptions are to be made concerning the appropriateness of any indicated location as it might be related to all of the site factors noted a~bove. Determination of precise locations will be the function of each Joint Powers Agency.for each Service Area, undertaken in the time when each identifies its needs more precisely than this Plan can do. Countywide and Service Area Joint Powers Agencies. An interim system of representation will be utilized.during the.JPA~forma- period. The Planning Policy Cortimittee for Santa Clara County iwill be tion - designed to function as the Solid Wasta Planning Committee during this ~period. Since they have been mentors of the Plan program over the past few years, this witl maintain continuity and wiil take advantage of the familiarity and expertise which they have developed. For this purpose the membership will be augmented with representation from the local solid waste industry in order to insure adequate and equitable considaration of the issues.
