A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
URGING THE BAY AREA SEWAGE SERVICES AGENCY BOARD OF
DIRECTORS TO TAKE IMMEDIATE ACTION TO TERMINATE AND DIS-
MISS THE LITIGATION RELATING TO WASTE-WATER PLANNING FOR
THE BAY AREA
WHEREAS, the Bay Area Sewage Services Agency has'been abolished by the
provisions of A13 3041, effective January l, 1977; and
WHEREAS, notwithstanding the fact that said Agency will go out of existence
on said date, it has begun litigation against the U. S. Environmental Protec-
tion Agency, Association of Bay Area Governments, State of California, and the
Water Resources Control Board; and
WHERE'AS,, the effect of this litigation, if successful, would force the
State of California to do the waste-water planning for the Bay Area, resulting
in a loss of local control and a waste of the planning monies spent to date; and
WHEP.EAS, the effect of this litigation, if unsuccessful, would be to waste
many thousands of tax dollars which should be used for purposes other than specious
litigation.
NOW, THEREFORE, BE IT RESOLVED that the Cupertino City Council urges
the B.A.S.S.A. Board of Directors to take immediate action to terminate and
dismiss its litigation above-referenced and to conserve tax dollars during
its final months of existence.

of Cupertino this lst day of November, 1976 by the following vote:
