CC Resolution No. 4422 ' } ~ RESOLUTION N0. 4422 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ADOPTING A CITY OF CUPERTINO MASTER STORM DRAINAGE FEE POLICY AND ESTABLISHING MAXIMIJM UNIT PRICES FOR MASTER STORM LINE INSTALLATION REIMBURSEMENT WHEREAS, the City Council of the City of Cupertino has adopted the Revised P~aster Plan, City of Cupertino Storm Drainage System, setting forth the fee structure as shown in the attached Exhibit "A"; and WHEREAS, the City requires developers to install parts of the master storm drain system as adopted by the City in the Revised Master Plan; and WHEREAS, the City has agreed to reimburse the developers for the actual construction cost of these master lines; and . WHEREAS, the reimbursement should not exceed the unit prices on which the storm drainage fees are collected; and WHEREAS, the unit prices shown in "Exhibit A" and made a part hereof by reference shall be the maximum reimbursement; ~ NOW, THEREFORE, BE IT RESOLVED THE1T: 1. The storm drain fee policy herein referred to is adopted. 2. The maximum reimbursement unit prices for master storm line installation reimbursement is hereby approved. 3. All resolutions and parts of resolutions in conflict with the newly adopted policies and procedures are hereby expressly re- scinded. 4. The following resolutions are specifically rescinded - Resolutions No. 79, No. 180, No. 466, and No. 633. Low density residential $950 per dwelling unit (Less than one dwelling unit per acre hillside zoning only) b. Single-family residential greater than $1,290 per gross acre one dwelling unit per. acre and less than 5.2 dwelling units per acre c. Multiple family greater than 5.2 $926 per gross acre plus dwelling units per acre $70 a unit* d. Commercial and industrial $2,420 per gross acre e. Public educational uses $950 per gross acre f. Public facility uses $480 per gross acre g. The Mark Thomas Revised Master Plan, City of Cupertino Storm Drainage System, dated October, 1975, as amended. 2. Storm Drain Master Plan Reimbursement Master Line - Master •line construction cost not to exceed City ~ reimbursement schedule. 3. Developer will construct drainage facilities to the nearest down-stream manhole or outfall outside development frontage. 4. Developer's credit will not be reimbursement from City of Cupertino engineering or other fees paid by the developer. 5.
