RESOLUTION N0. 4572 A RESOLUTION OF THE CITY COWCIL OF TNE CITY OF CUPERTINO MAKING APPLICABLE THE PROVISIONS OF THE CAi,IFORNIA VE- HICLE CODE TO PRIVATE ROADS WITHIJ1;10RTHPOI,IT SUBDIVISION TRACTS NUMBERED 5070 AND 5071, LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF HOMESTEAD ROAD AND BLANEY AVENUE WHEREAS, Northpoint Subdivision, Tracts numbered 5070 and 5011, lo- ca[ed at the southvest corner of Che intersection of Homestead Road and Blaney Avenue, contains privately owned and maintained roads within the City of Cupertino that are not generally held open for use of the public for purposes of vehicular travel, but, by reason of their proximity to, or connection with highways, the interes[s of any resident residing along such roads and the motoring public will best be served by application of the provisions of the California Vehicle Code to such roads; and WHEREAS, there was filed with the Clty oE Cupertino a peti[ion request- ing such application by a majority of the owners of such privately owned and main[ained roads; and WHEREAS, a public hearing with respect to such petition was duly and regularly held by the City Council of the City of Cupertino on the 3rd day of October, 1977, after ten (10) days prior written notice to all owners of such roads. vOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino, State of California, pursuant to Section 21107.7 of the California Vehicle Code, that the provisions of [he California Vehicle Code shall apply to the privately owned and maintained roads hereinabove described, provided appropriate signs are erected by the property owners at the entrance to such roads, of such size, shape ~ and color as to be readily Legible during daylight hours Erom a distance of one hundred fee[ (100'), to the effect that the road 1s sub~ect to the provisions of the California Vehicle Code; and BE IT FURTHER RESOLVED, that [he Director of Public Works of [he City of Cupertino is hereby authorized and directed to supervise the erection of any such signs by the property owners, as well as any additional signs which may be required to be erected in the future, all of which signs shall be erected bp the property owners at their sole cost and expense.
