(,275 ~ ' A RESOLUTION OF THC CITY COUNCIL OF THE i CITY OF CUPERTINO I2~GARDING CITY POLICY OF ANNEXATION ~ OF INliI~BITED PROPERTY AS IT APPLIES TO THE CRESTON AREA WHEREAS, the City Council of the City of Cupertino has previously adhered to a policy of not annexing inhabited territory if there were a majority protest of resident voters within such territory as prescribed by State law; and WHEREAS, the City Council of the City of Cupertino has no desire to annex inhabited territory in which such majority protest exists; NOW, THGREFORE, BE IT RESOLVED by the City Council of the City of Cupertino as follows: I. The policy of the City Council of the City of Cupertino as described in the above recitals is hereby affirmed and is specifically applied to the territory commonly known as the unincorporated area of the Creston subdivision in the County of Santa Clara. Specifically, the City of Cupertino shall not annex any inhabited portion of the Creston subdivision if there exists a majority protest of resident voters within the area to be annexed. II. The adoption of this policy in no respect modifies the previously adopted policy of the City Council of the City of Cupertino which inalterably opposes any change in the "sphere of influence" boundary with respect to the Creston subdivision and which opposes any consideration by any relevant public body of annexation of the Creston subdivision to the City of Los Altos.
