Application No.: Applicant: Location: CP-2000-09 (EA-2003-08) City of Cupertino Citywide The following items were discussed: u Discussion of future trends in wireless communications. o Many antennas will move into neighborhoods. u Radio frequency radiation. Federal law prohibits the denial of an application based on radiation levels. The Federal Communications Commission has established maximum permissible exposure levels. o Exposure standards are in place. Hazardous materials is used in generators. o Diesel fuel and sulfuric acid is used for the battery in case of a power outage. o Fire Department reviews all building permits to make sure use of hazardous materials complies with City ordinance. Hazards o Emergency back-up generators may create excessive noise. Such generators are reviewed at the building permit stage to make sure that they comply with the City's noise ordinance. o Non-traditional building materials used in treepoles, such as fiberglass, could create a falling material hazard. Language in the master plan allows the City to require special studies to ensure materials are safely used. Land Use and Planning. o Current ordinances prohibit commercial antennas in residential areas. The draft master plan recommends that these zoning ordinances be amended to allow these facilites. ACTION: Recommendation for a Mitigated Negative Declaration with the following mitigations: 1. Aesthetics Mitigations - The Master Plan includes policies on location, siting and design and guidelines for siting and design. 2. Hazard Mitigations - The small quantities of hazardous materials used are regulated by the City's Hazardous Materials Ordinance. Non-standard building materials, such as fiberglass, will be evaluated to make sure it does not pose a failing hazard. 3. Land Use Mitigations - Before facilities are allowed in residential areas, applicants must demonstrate their safety from a RFR standpoint and lessen visual impacts through design. Noise Mitigations Ventilation and back-up generator equipment may exceed noise standards and must meet the City Noise Ordinance.
