RESOLUTION OF INTENTION
TO CONSTRUCT STREET PAVEMENTS, CUT BS, GUTTERS, STORM SEWERS,
SANITARY SEWERS, WXI'ER :DINES, GAS LINES, LIGHTING, AND ALL
OTHER WORK AUXILIARY THE ill,"T'0

RESOLVED, by the City Council of the City of Cupertino, State
of California, as follows:
SECTION 1: That the public interest and, convenience require,
and it is the intention of said City Council to order., the follow-
ing work to be done and improvements to be made in that portion of
the City of Cupertino herein:,fter termed Corte Madera Highlands
Local Improvement District, to -wit:
FIRST: The construction of plant mix street pavements, con-
Crete curbs and gutters, storm sewers, sanitary sewers, water lines,
gas lines, lighting, and all other work auxiliary thereto; such
miscell=aneous work necessary to provide uniformity with existing
improvements; and to provide adequate drainage; all. thereof, except
water lines, gas lines, and lighting, to be in accordance with Plans
and Specifications heretofore adopted and approved, in the foll.o:•riuz
proposed streets of said City, as shown upon said Plans and Specifi-
cations, and also being within the boundaries of the Assessment
District map heretofore approved and adopted by Resolution of said
City Council and on file with the - �lerk thereof.

and also within the easements shown thereon.
SECOND: There is excepted from the work above described such
portions wherein existing utilltie;3 may be incorporated in the work
and as marked or shown to be so incorporated in the Plans and Speci-
fications.

THIRD: In the foregoing descriptions, wherever any work is
described to be done, it is the intention that said work shall
also be extended so as to connect with work to be done on inter -
secting streets or public ways, as shown in the Plans and Speci-
fications.
SECTION 2: All said work and improvement shall. be constructed
at the particular locations, in the forms, and of the sizes, di-
mensions, and materials, and to the lines and grades, and at the
elevations as shown on the Plans and Specifications heretofore
adopted by the said City Council, and now on file in the office of
the Clerk of the City of CUT)ertinc >, reference to which is hereby
made for a full and detailed description of the proposed work and
improvements.
SECTION 3: Said City Council does hereby adopt and establish as
the official grades for said work, the grades and elevations shown
upon the Plans. All such elevations are shown in feet and decimals
thereof from U.S.G.S. datum. Notic�- is hereby given that whereas
these grades conform as closely as is feasible to existing improvements,
there will be instances where the ne grades are other and different
from the existing surface grades of the present unimproved portions
of the area.
SECTION 4: In the opinion of said City Council, the said work
Is of more than local or ordinary public benefit, and said City
Council orders that the cost and expense of said work and improvement
shall be chargeable and charged upon a district, which district is
hereby declared to be the district benefited by said work and im-
provement, and to be assessed to ;gay the cost and expenses thereof,
saving and excepting therefrom the area of all public streets and
other public ways to be included therein.
The exterior boundaries of said assessment district and the ex-
tent of the territory included therein are shown upon said map of
said district hereinbefore mentioned, approved and adopted by said
City Council and now on file with the said Clerk of said City Council.

SECTION 5: The proceedings for said work and improvement shall
be had and taken under and in accordanne with Division 7 of the
Streets and Highways Code of the State of California (Improvement Act
of 1911), and all said work shall b,� clone under the supervision of
the Engineer of Work, and all work and materials shall. be to his
satisfaction.
SECTION 6: Notice is hereby given that serial bonds shall be
issued pursuant to Part 5 of Division 7 of said. Streets and Highways
Code (Improvement Act of 1911) to represent the unpaid assessments of
twenty -five dollars (" or over, for the cost of said work, said
bonds to bear interest at the rate of six per cent (6 ) per annum and
to extend for a period of fourteen ;14) years from the second day of
January next succeeding the next October 15th following; their date, and
to be payable in annual installment:, the last installment thereof to
mature fourteen (14) years from the second day of January next succeed-
ing the next 15th day of Octobcr following their date, said bords a.nd
the interest thereon to be payable as provided in said Code.
- SECTION 7: Notice is hereby g..ven that , �. "the '

hereby are fixed as the time and place when and. where any and all persons
having any objections to or protests against said work and improvement,
or to the extent of said assessment district, or to both, or against the
grades at which said work is to be done, may make written protests, said
protests to be filed in the office of said Clerk of said City Council at
any time not later than the time set. for hearing such protests, at which
time any and all persons so protesting; will be heard by said City Council.

SECTION 8: The Engineer of Work shall cause to be posted con-
spicuously along the line of said contemplated work and improvement,
and along; all the open. streets within said assessment district,
notices of the passage of this Resolution of Intention, as provided
by law.
SECTION 9: The Clerk of said City Council shall certify to the
passage of this Resolution, and shall cause the same to be published
twice, as required by law, in the Cupertino Courier, a newspaper
published and circulated within said City, and hereby designated for
that purpose by said City Council there being no newspaper published
and circulated in said assessment district, and said Clerk is hereby
directed to mail notices of the adoption of this Resolution as pro-
vided by lww.
SECTION 10: Reference is hero;�by made to the Petitions on file
in the office of said Clerk of said City Council and proceedings of
said City Council thereon, pursua to Section 2804 of the Streets
and Highways Code.
PASSED AND ADOPTED by the City Council of the City of Cupertino,
