IT REI)OLVED .ICY_ THE CITY COUNCIL OF THE CITY OF CUPERTINO AS FOLLOWS: Section 1: Resolution 4i'IA.adopted.July 7, 1964 is hereby repealed. Section 2: All Resolutions, Minute Orders and Notions previously adopted by the City Council in conflict with this Resolution 4710 are hereby rescinded and repealed. Section 3: Exhibit A entitled "Position Titles by Pay Grades" and Exhibit B entitled "Salary Schedule ", both dated July 1, 1967 and attached hereto are hereby adopted. Section 4: Sections I through..11 of.Itesolution 471 and Exhibit A attached thereto are hereby repealed and in lieu thereof the pro- visions of Section 5 of this Resolution 471C are hereby adopted. Section 5: Sections. 7, through 11 of Resolution 471 shall read as follows: "Section 1: All conflicting. resolutions of the City are hereby repealed. Section 2: The plan has the following characteristics: (a) Each pay-grade has ..five. steps and no salary rate shall be at other than that indicated for one of the steps for the pay grade , to which the position title is assigned, except as otherwise provided Exhibit A attached hereto, (b) Rates - of pay for employees entering the City's service normally will be at . the• s tep 1 rate for 'the position title unless otherwise - conditioned by recruiting diffi- culties or by education %or expt:rience in excess of that usually required of a nev employee. Section 6: Monthly salaried employees for any reason, are to be paid less than their normal gross salary for. any one pay period shall have their gross salary computed_ by deducting from their normal salary rate the dollar amount for the number of hours not worked Wultiplied by the hourly equivalent for full -time employment during the month in which the pay period falls. No salary shall be paid tinder this pro- vision avaless the employee is entitled to receive pay for one or more days during the pay period. Section 7: The permanent assignment. of an employee from one position title to a position title in a higher pay grade shall con- stitute a promotion and the affected employee shall receive an increase in salary on promotion. Section 8: The normal, work week shall be forty hours for all full -time employees except for those staff members who may, in addition, be required to attend or participate. in. official City functions outside or their normal working hours. Compensatory time off as a result of such activity shall not accrue . as . a. right - to any employee but may be given as a consideration 'by the City Manager. Compensatory time off may Rie granted by the City Manager to other employees who arts requested to cork overtime. Section 11: All new employees shall.serve a six - month pro - baltxonary period. Employees on probationary; status and part -time employees are not eligible. for sick leave benefits, or other "ne- fits that will or may be granted to..permanent employees, excluding eligibility for receiving. compensation and medical care under the provision of the State Compensation Act. Accrued vacation leave will not be paid to any employee leaving. City service prior to the completion of one year's service." Section 6: Section - 14 of Resolution 471 is hereby repealed.
