SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-29
This letter confirms the decision of the Director of Community Development, given on
November 28, 2006; approving a Residential Design Review for a new 3,243 square foot,
two story residence, located at 11081 S. Stelling Rd. (lot 1), with the following
conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, "Catalano - Lot I, Five Detached
Single-Family Residences, 11081 S. Stelling Rd., Cupertino CA" consisting of
eleven sheets dated December 12, 2005, April'06, October '06 and November IS,
2006, except as may be amended by conditions in this resolution.
2. MAINTENANCE AGREEMENT
The applicant shall record a reciprocal easement and road maintenance covenant
with the County of Santa Clara prior to the issuance of building permits.
3. SOUTH ELEVATION
All second story window sills on the south side of the property shall be at least
six feet from the second story finished floor.
4. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future
property owners of the privacy protection measures and tree protection
requirements. The precise language will be subject to approval by the Director of
Community Development. Proof of recordation must be submitted to the
Community Development Department prior to final occupancy of the residence.

5. PRIV ACY PROTECTION PLAN
The applicant shall plant 36" box trees in numbers and type from the privacy
protection planting list at the side and rear property line to mitigate any privacy
impacts from the second story windows prior to approval of building permits. A
privacy protection plan shall be reviewed and approved to the satisfaction of the
Community Development Department prior to issuance of building permit.
6. GOOD NEIGHBOR FENCE
The applicant shall construct a good neighbor fence, at least seven feet in height
(no trellis), along the south side of the lot one prior to issuance of building
permits.
7. SETBACKS
The front (facing Stelling Rd.) and side (north) setback and shall be measured
from the top of the street curb. All other setbacks shall be measure from the
property line.
8. REAR SETBACK
The rear setback shall be 20'. The plans show a 19'-8" rear setback. The
applicant shall revise the plan to show a 20' rear setback prior to issuance of
building permit.
9. PROTECTED TREES
Trees #55, #58, #62 and #67 shall remain and be protected according to the arbor
report dated June 2, 2006 unless otherwise approved by the Director of
Community Development.
10. TREES REQUIRED
One 24" box tree is required by the Single Family (R1) Ordinance. Five (5) Italian
Cypress shall be planted along the south property line of Lot 1.
11. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
12. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (I), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
During the review period, the property owners of 11101 Stelling Rd. notified staff of
their concerns for privacy and setback of the home. To mitigate the privacy concerns,
the applicant has agreed to modify the second story windows on the south side of the
property. The window sills will be at least six feet from the second story finished floor.
In addition, the applicant has agreed to construct a good neighbor fence on the south
property line of lot 1 and plant additional screen trees along the south side. These
modifications are included in the conditions of approval. The minimum setback of the
home was determined with the approval of the subdivision of the project site. The
proposed home on Lot 1 complies with the requirements of the zone.
Please be aware that if this permit is not used within one year, it shall expIre on
November 28, 2007.
The project has met all of the required findings of approval for a Two-story Residential
Permit and the Minor Residential Permit as required by the of Cupertino's Municipal
Code, Chapter 19.28.090 (B) and 19.28.100 (D). Please note that an appeal of this
decision can be made within 14 calendar days from the date of this letter. If this
happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.
