SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-32
This letter confirms the decision of the Director of Community Development, given on
November 28,2006; approving a Residential Design Review for a new 3,960 square foot,
two story residence, located at 11081 S. Stelling Rd (lot 4), with the following
conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, "Catalano - Lot 4, Five Detached
Single-Family Residences, 11081 S Stelling Rd. Cupertino CAlf consisting of
eleven sheets dated December 12, 2005, April '06, October '06 and November 15,
2006, except as may be amended by conditions in this resolution.
2. MAINTENANCE AGREEMENT
The applicant shall record a reciprocal easement and road maintenance covenant
with the County of Santa Clara prior to the issuance of building permits.
3. SETBACKS
The front (facing Catalono Ct.) setback and shall be measured from the top of the
street curb. All other setbacks shall be measured from the property line.
4. PRIV ACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future
property owners of the privacy protection measures and tree protection
requirements. The precise language will be subject to approval by the Director of
Community Development. Proof of recordation must be submitted to the
Community Development Department prior to final occupancy of the residence.

5. . PRIVACY PROTECTION PLAN
The applicant shall plant 36" box trees in numbers and type from the privacy
protection planting list at the side and rear property lines to mitigate any privacy
impacts from the second story windows prior to approval of building permits. A
privacy protection plan shall be reviewed and approved to the satisfaction of the
Community Development Department prior to issuance of building permit.
6. PROTECTED TREES
Trees #4-#18 and #21 shall remain and be protected according to the arbor report
dated June 2, 2006 unless otherwise approved by the Director of Community
Development.
7. TREES REQUIRED
Trees shall be planted on the north side of the property to provide screening for
the neighbor to the north. One 24" box tree is required by the Single Family (R1)
Ordinance. The specific location and type of all trees required shall be specified
in a revised landscape plan and approved by the Director of Community
Development prior to approval of building permits.
8. CONSULT A TION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020( d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
During the review period the property owner of 7728 Obsidian Ct. raised view concerns
for privacy. The applicant has agreed to plant screen trees on the north property line to
mitigate the neighbor concerns. This is a condition of approval.
Please be aware that if this permit is not used within one year, it shall expIre on
November 28, 2007.
The project has met all of the required findings of approval for a Two-story Residential
Permit and the Minor Residential Permit as required by the of Cupertino1s Municipal
Code, Chapter 19.28.090 (B) and 19.28.100 (D). Please note that an appeal of this
decision can be made within 14 calendar days from the date of this letter. If this
happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.
