SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-40:
This letter confirms the decision of the Director of Community Development, given on
August 18, 2006, approving a residential design review for a new two-story, 4,085
square foot residence, located at Alcazar Place (Parcel 3), with the following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, /I A New Residence for Mr. & Mrs.
Hsing Kung, Alcazar Place (Parcel 3), Cupertino, CA," consisting of five sheets
dated July 11, 2006, except as may be amended by conditions in this resolution.
2. COMPLIANCE WITH TENT A TIVE MAP APPROV AL
This approval is based upon compliance with Planning Commission Resolution
No. 6351, approving TM-2005-13. No building permit(s) shall be issued for the
construction of this project until the Final Map for this subdivision has been
recorded.
3. PRIVATE ROADWAY
A homeowners association shall be established with a CC&R that addresses
maintenance and upkeep of the private road, streetlights, and any improvements
associated with the private road. The CC&R shall be reviewed and approved by
the City and shall be recorded prior to approval of the Final Map. The private
road shall be paved with interlocking pavers or similar semi-pervious materials.
The final paving material shall be reviewed and approved by the Public Works
and Planning Departments prior to issuance of building permits.
4. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future
property owners of the privacy protection measures and tree protection
requirements consistent with the R-l Ordinance for all windows with views into
neighboring yards and with a sill height that is 5 feet or less from the second
story finished floor. The precise language will be subject to approval by the
Director of Community Development. Proof of recordation must be submitted to

the Community Development Department prior to final occupancy of the
residence.
5. PRIV ACY PROTECTION PLAN
Prior to issuance of building permit(s), the applicant shall provide a revised
privacy protection plan that provides privacy protection landscaping along the
west and south property lines, in addition to the rear and east side yard property
lines, to address second story window impacts, or submit signed privacy
protection waivers. The revised privacy protection plan shall be reviewed and
approved by the Community Development Department prior to issuance of
building permit(s). If existing trees are being proposed to serve as privacy
screening, the City Arborist must confirm that the existing trees are appropriate
for screening purposes in terms of species, size and health. If deemed
appropriate, the existing trees will be recorded on the property as protected trees
along with the new privacy trees.
6. FRONT YARD TREES
A new 24-inch box tree will be required to be planted in the front yard to meet
landscaping requirements. The species of the tree to be planted shall be reviewed
and approved by the City.
7. CONSULT A TION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
8. NOTICE OF FEES. DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (I), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on
August 18, 2007.
Staff received comments on this project from three neighbors. One comment included
concerns about this proposed project being too close to the east and north property lines
and being an obstruction to views from the adjacent properties to the north and east.
Staff has reviewed this comment and finds that the proposed project is in compliance
with all development requirements for the Rl-7.5 zoning district, including setback and
height requirements.
Another comment included concerns about construction noise that will be created as a
result of the construction of this project and a request to delay construction due to a
neighbor's health condition. Staff has spoken to the neighbor and explained that
construction activities will be required to comply with the City's Municipal Code
regarding construction noise and hours of operation. Additionally, staff explained to
the neighbor that the City has no means to delay construction due to her health
condition; however, staff recommended that she contact the applicant to request the
applicant to voluntarily delay construction of his project.
Staff also received questions from an adjacent neighbor to the project site who asked for
clarification on the shared easement on his property and garbage pick up for the
subdivision. The applicant has indicated that the new private roadway access into the
subdivision will not affect the existing shared easement on the adjacent neighbor's
property and that the applicant will work with the adjacent neighbor to abandon this
easement. The applicant has also indicated that the garbage pick up will occur within
the private street and will not impact the adjacent neighbor's property.
Please note that an appeal of this decision can be made within 14 calendar days from
the date of this letter. If this happens, you will be notified of a public hearing, which
will be scheduled before the Planning Commission.
