SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-59:
This letter confirms the decision of the Director of Community Development,
given on July 18, 2007; approving a residential design review for a new two-
story, 4,605 square foot residence, located at 10114 Crescent Court (lot 4), with
the following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, "New Two Story House, Crescent
Court Lot 4 California," consisting of twelve sheets stamped "Received,
November 16, 2006", except as may be amended by conditions in this resolution.
2. TREE COVENANT
The property owner shall record the tree covenants as required by the Tentative
Map application, TM-2006-10, conditions of approval. This includes the protected
oak trees on the property, the oak tree planted in the front yard and one
additional tree next to the oak tree in the front yard.
3. TREES
No construction equipment shall be stored under the canopy of the trees on the
property . No more than 25 % of the protected trees on the property shall be
pruned in any 12-month period. This needs to be done per the recommendations
of an Internationally Certified Arborist. Prior to issuance of building permits, the
applicant shall submit plans showing the following on a landscaping plan:
1. No turf or plant material beneath the canopy of the pak trees.
2. Drought tolerant plants within the canopy of the oak trees and established
at least five to ten feet from their trunks.
3. Irrigation beneath the tree canopies should not strike within 5 feet of
established oak trees.
4. Stones, mulching or fencing should not be placed against the trunks of the
trees.
5. Trenching and tilling under canopy should be avoided. Please indicate
where trenching will be conducted if any is proposed. This trenching shall

be manually conducted using shovels. All roots of two inches or greater
diameter shall be retained in the process and tunneled beneath, if
necessary.
6. Bender board or other edging material proposed beneath the canopy
should be established on top of existing soil grade.
4. PRIV ACY PROTECTION WAIVER
The property owner of Lot 5 shall obtain a privacy protection waiver from the
property owner of Lot 4.
5. PRIV ACY PROTECTION PLANTING PLAN
In conjunction with the building plan check submittal, the applicant shall
provide a revised privacy protection planting plan to reflect the planting of one
tree along the southerly property line adjacent to the proposed new oak tree.
6. ARCHITECTURAL CHANGES
The applicant shall do the following:
a. Move the house three feet in the northerly direction.
b. Reduce the storage area from being 6'11" by 6'0" to 6'11" by 2'2".
c. Relocate the storage area door from the south side to the east side.
d. Include the bay window along the north of the house in the FAR
calculations.
7. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future
property owners of the privacy protection measures and tree protection
requirements consistent with the R-1 Ordinance for all windows with views into
neighboring yards and with a sill height that is less than 5 feet from the second
story finished floor. The precise language will be subject to approval by the
Director of Community Development. Proof of recordation must be submitted to
the Community Development Department prior to final occupancy of the
residence.
8. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and! or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on July 18,
2008.
Staff received one phone call with regard to privacy protection and tree impacts. The
neighbor to the south was concerned about the privacy impacts of the second story
being proposed. The applicant has made changes to accommodate the neighbors
concerns by moving the house further away from the neighbor's property and by
reducing the size of the storage area located behind the garage.
Staff has made all the findings that are required for approval of a Two-story Residential
Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B) and
19.28.100 (D). Also, please note that an appeal of this decision can be made within 14
calendar days from the date of this letter. If this happens, you will be notified of a
public hearing, which will be scheduled before the Planning Commission.
