SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-22 and
RM-2006-20:
This letter confirms the decision of the Director of Community Development, given on June
30, 2006; approving a Residential Design Review for a new 3,874 square foot, two story
residence and a Minor Residential Permit for a reduced rear yard building setback, located at
22314 Cupertino Road, with the following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitled, "New Residence for Sanjay & Geetha
Rao, 22314 Cupertino Road, Cupertino CA" consisting of thirteen sheets dated
received on May 25, 2006 except as may be amended by conditions in this resolution.
2. WINDOWS ON FRONT ELEV A TION
The property owner shall submit new plans prior to issuance of building permits
showing new window designs that are more consistent and less varied.
3. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and h'ee protection requirements. The
precise language will be subject to approval by the Director of Community
Development. Proof of recordation must be submitted to the Community
Development Department prior to final occupancy of the residence.
4. PRIVACY PROTECTION PLAN
If existing trees are being proposed to serve as privacy screening, the City Arborist
must confirm that the existing trees are appropriate for screening purposes in terms of
specie, size and health. If deemed appropriate, the existing trees will be recorded on
the property as protected h'ees along with the new privacy trees. The applicant shall
plant 36" box h'ees in numbers and type from the privacy protection planting list at
the rear property line to mitigate any privacy impacts from the second story windows
prior to approval of demolition permits.
5. ADDITIONAL TREE REPORT
The City Arborist shall review the grading plans submitted by the applicant to review
whether the oak trees on site and in the public right-of-way will be affected by the
proposed grading and what measures should be taken to prevent damage to the oaks.

6. TREE REPLACEMENT
An existing 24" incense cedar tree will be removed as part of this approval. A 48" box
oak tree is to be planted in the front yard in addition to the 24" box front yard planting
required by the Single Family (R1) Ordinance.
7. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
8. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66D2D(d) (1), these Conditions constitute written notice of a
statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 9D-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66D2D(a), has begun. If you fail
to file a protest within this 9D-day period complying with all of the requirements of
Section 660'20', you will be legally barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on June 30',20'0'7.
Staff received comments from neighboring residents regarding the proposed residence.
Some of the comments were about the privacy impacts of the second story windows. One
neighbor wanted larger privacy h'ees planted as soon as possible so the trees could grow to
prevent views into his backyard. Another neighbor commented that they did not want any
privacy trees between the two properties and would be willing to sign a waiver. One
neighbor also commented about the design of the house and the proposed grading for the lot
and his comments have been forwarded to the applicants. One person called with questions
about a power pole on the street. However, since the power pole is not on the applicant's
street frontage, the applicant is not required to underground the lines.
The project has met all of the required findings of approval for a Two-story Residential
Permit and the Minor Residential Permit as required by the of Cupertino's Municipal Code,
Chapter 19.28.0'90' (B) and 19.28.10'0' (D).
Please note that an appeal of this decision can be made within 14 calendar days from the date
of this letter. If this happens, you will be notified of a public hearing, which will be
scheduled before the Planning Commission.
