RM-2006-25 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 777-3308 FAX: (408) 777-3333 COMMUNITY DEVELOPMENT CITY OF CUPERJINO November 28,2006 Leonard Hufton 4125 Blackford Ave. #200 San Jose, CA 95117 SUBJECT: RESIDENTIAL DESIGN REVIEW ACTION LETTER - Application R-2006-33 and RM-2006-25 This letter confirms the decision of the Director of Community Development, given on November 28, 2006; approving a Residential Design Review for a new 3,821 square foot, two story residence and a Minor Residential Permit for a reduced rear yard building setback, located at 11081 S.Stelling Rd (lot 5), with the following conditions. 1. APPROVED PROTECT This approval is based on a plan set entitled, "Catalano - Lot 5, Five Detached Single-Family Residences, 11081 S. Stelling Rd., Cupertino CA" consisting of eleven sheets dated December 12, 2005, April '04, October '06 and November 16, 2006, except as may be amended by conditions in this resolution. 2. MAINTENANCE AGREEMENT The applicant shall record a reciprocal easement and road maintenance covenant with the County of Santa Clara prior to the issuance of building permits. 3. SETBACKS The north setback (facing Catalono Ct.) shall be measured the top of curb. All other setbacks shall be measured from the property line. 4. EAST ELEVATION The second story bedroom window sill on the east side of the property shall be at least six feet from the second story finished floor and the glass shall be obscured. 5. PRIV ACY PROTECTION COVENANT The property owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements. The precise language will be subject to approval by the Director of Printed on Recycled Paper 6. PRIV ACY PROTECTION PLAN The applicant shall plant 36" box trees in numbers and type from the privacy protection planting list at the side and rear property line to mitigate any privacy impacts from the second story windows prior to approval of building permits. A privacy protection plan shall be reviewed and approved to the satisfaction of the Community Development Department prior to issuance of building permit. 7. GOOD NEIGHBOR FENCE The applicant shall repair and/or replace (as needed) the mutual fence at the property line of Lot 5 prior to issuance of building permits. 8. PROTECTED TREES Trees #34, #36, and #39 shall remain and be protected according to the arbor report dated June 2, 2006 unless otherwise approved by the Director of Community Development. 9. TREES REQUIRED To replace the 7" buckeye tree that was removed, two 24" box trees are required to be planted. One 24" box tree is required by the Single Family (R1) Ordinance. 10. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/ or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 11. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. During the review period, the property owners of 11061 Stelling Rd. and 21025 Classic Ct. notified staff of their concerns for privacy. To mitigate the privacy concerns, the applicant has offered the following mitigations, which have been incorporated into the development plans: . Modify the second story bedroom window on the east side of the property 0 The window sill will be at least six feet from the second story finished floor with obscured glass. . Plant additional shrubs on the north property line. . Modify the location of the house so that it is at least 10 feet from the side property line. Repair or replace their mutual fence along the property line of lot 5. Please be aware that if this permit is not used within one year, it shall expire on November 28, 2007. The project has met all of the required findings of approval for a Two-story Residential Permit and the Minor Residential Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B) and 19.28.100 (D). Please note that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission.
