Subject: Director's Minor Modification, DIR-2012-11, to a previously approved Use Permit
(U-1985-32) to allow the construction of a 900 square foot accessory storage building,
the enclosure of an existing open entry area and the construction of a small parking lot
at an existing retirement community (The Forum at Rancho San Antonio)
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the decision
within fourteen calendar days.
DISCUSSION
The applicant, Louie Leu, representing The Forum at Rancho San Antonio, proposes minor
improvements at the existing retirement community. The changes include:
1) Construction of a 900 square-foot accessory storage building that matches the style and
materials of the existing buildings. The storage building is sited next to another storage
building in an existing parking lot and will remove five parking stalls. (See plan set.)
2) Construction of a new 6-stall parking lot on the other side of Via Esplendor to replaced
the five (5) parking stalls displaced by the proposed storage building. Plan set sheet C2.0
erroneously indicates that four trees will be removed by the parking lot project. In fact,
the removals are Oleander shrubs.
3) Construction of a new entry enclosure at the main entrance of the community building.
The enclosure consists of glass storefronts and an automatic sliding door for a portion of
the existing porte cochere.
The changes are interior to the development and visible only to residents, guests and employees
of the Forum community.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:

dated 03/09/12, and labeled A-0.0, A-1.1, A-2.1, A-3.1, C 1.0 to C3.0, DTO 1, DT02, except
as may be amended by the conditions contained in this memorandum.
2. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount
of such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Govei-nment Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later challenging such
exactions.
This Director's approval is effective April 26, 2012. The fourteen calendar day appeal period
will expire on May 10, 2012. Please be aware that if this permit is not used within two years, it
shall expire on April 26, 2014.
