Subject: Director's Minor Modification, DIR-2012-14, to allow a below-grade emergency
generator with an above-ground, screened,e�chaust stack at an existing office complex
located at 10200 South De Anza Boulevard
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Gary Wong, representing Seagate Technology, is requesting a modification to a
previously approved Use Permit (U-1996-11) to allow a below-grade emergency generator with
an above-ground, enclosed, exhaust stack at the existing Seagate office complex. See below for a

Displace��ie�1t of Parking Spaces
The emergency generator is proposed on the first level of the below-grade parking garage,
which will require the removal of six existing parking spaces. According to the original use

permit approval for the building (U-1996-11) and a subsequent modification in 1997, the site is
required to provide a minimum of 669 parking spaces. There are currently 766 auto parking
spaces onsite, and with the removal of six stalls, there would be 760, which still exceeds the
required rate. In addition, Seagate has a transportation demand management (TDM) program,
including an employee commuter bus and additional offsite parking.
Noise Considerations
The below-grade generator is to be buffered by an acoustical enclosure designed to minimize
noise impacts. Except in the event of an emergency, the generator is to run normal testing once
a week for 30 minutes during non-sensitive hours. The project acoustical consultant, Stan
Shelly, reviewed the acoustical enclosure design and confirmed that it meets the standards of
the Community Noise Control Ordinance (Attachment 1). A condition has been added for the
project acoustical consultant to review the final construction plans and as-built construction
prior to final inspection to confirm that the ordinance standards are met.
Visunl Considerc�tions
The generator's above-grade exhaust stack is to be screened from public view by a modern-
themed screening tower, approximately 12'5" high. The screening tower is to be located
approximately 245 feet from the sidewalk on De Anza Boulevard. The tower will be painted to
match the Seagate building and will feature metal reveals and pedestrian-scale lighting. A
condition has been added for the applicant to work with staff on its final visual details during
the building permit phase.
The generator is to be serviced by a wall-mounted fuel fill station on the interior (east) side of
the main Seagate building, along the ramp down to the below-grade parking garage. The fill
station will be painted to match the building wall. Due to fire rating requirements, the window
above the fill station is to be replaced by a fire-rated stucco infill panel, which will be designed
to match the existing building wall.
Condusion
Staff supports the project because it is generally consistent with the original approval and noise
and visual impacts have been addressed. The Building Division and Santa Clara County Fire
Department reviewed the project and have no objections. Adjacent property owners were also
notified and no comments were received.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Proposed Emergency Power Generator for Seagate,
10200 South De Anza Boulevard, Cupertino, California," prepared by archespace GWSC,
PM Greene Engineers, and Rinne & Peterson Structural Engineers, dated March 8, 2012 with
a revision date of April 11, 2012 and consisting of 10 sheets labeled A0.0, A0.1A, A0.1B,
A1.00, A1.01, A1.1, A2.1, A3.1, A3.2, and A3.3; except as may be amended by the conditions
contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard

to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. GENERATOR TESTING
Except in the event of an emergency, the generator may only conduct test runs during non-
sensitive hours, which is typically between the hours 8am to 8pm on weekdays and 9am to
6pm on weekends.
4. ACOUSTICAL CONSULTANT REVIEW
Prior to building permit issuance, the project acoustical consultant shall review the
construction plans and confirm that the sound enclosure is in compliance with their
recommendations and the Community Noise Control Ordinance (Chapter 10.48). Prior to
final inspection, the project acoustical consultant shall be retained to inspect the enclosure
and confirm that noise levels are still within the standards of the ordinance.
5. ADDITIONAL MODIFICATIONS TO SCREENING TOWER
Prior to building permit issuance, the applicant shall work with staff to make additional
design modifications to the exhaust stack screening tower. The design intent is to make the
tower look like it is serving a purpose other than screening the exhaust stack. The
modifications include,but are not limited to the following:
a. Lower lights to a human scale, such as 8 feet above grade. The plans shall demonstrate
that there will be no off-site glare from the lights, which typically includes shielding
devices and lower lighting intensity.
b. Add a signage enhancement or other architectural feature to the screening tower, such as
the address numbers, directional signage, etc.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective May 3, 2012. The fourteen calendar day appeal
period will expire on May 17, 2012.

I have reviewed the latest version of the architectural drawings for the subject project, dated March
2012,which include a complete double-stud wall generator enclosure, a double-wide acoustic entry
door, and an intake air baffle connecting the enclosure to the garage. These architectural design
elements, as well as an engine exhaust muffler and a cooling air exhaust muffler, as described in my
letter to Greene Engineers of Feb. 7, 2012, are expected to allow the project to meet City noise
criteria, also described in the Feb. 7 ECS letter.

perform no portion of the work at ony dme without o permit Issued by a regulatory a�thority of the m�nlclpality In
which the projed fs located.
B. The Controctor shall perform the Work in accordance with oll laws,ordinances,rules,and regulations of all governing
agendes.
C. Priw to bidding or pridng,the Contractor shall vlsit the site and become dcquainted with all conditions relating ro the
construction and completion of the Projecr and rhe employment of labor thereon. Failure ro do w will not reileve the
Coniractor of Fis�her obligations to furnish all equipment,materials,lubor,and service;necessoty to carrr uut ihe
provfsions of the Controct.
D. The Conrractor and his subcomracton shall purchase and maintain certiflmtes of Insurance with rospect to Workers
CompensaHon,P�bik Liability and Property Domage for the Ilmits as requlred by law.The Certificata shall name the
Owner os additionally insured.
