Subject: Director's Minor Modification, DIR-2012-21, to a previously approved Architectural
and Site approval (ASA-2006-14) to allow an outdoor seating area and associated
patio enhancements at an existing restaurant in Building C of the Marketplace
Shopping Center,located at 19620 Stevens Creek Boulevard, #150
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Corrunission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Mark Battistini, representing KCR Development, is requesting a modification to
a previously approved Architectural and Site Approval (ASA-2006-14) to allow an outdoor
seating area and associated patio enhancements at an existing restaurant (Gyu-Kaku) in
Building C of the Marketplace Shopping Center. The outdoor seating area is to be located on an
existing covered patio behind the restaurant along the Stevens Creek Boulevard frontage.
Condition #4 of ASA-2006-14 requires Director of Community Development approval for new
outdoor seating,provided that adequate parking is provided,
Parking Considerations
The outdoor seating area consists of three tables and 12 total seats. The 12 outdoor seats are less
than 20% of the restaurant's 76 interior seats as required by the General Commercial (CG)
Ordinance. The addition of the outdoor seating area is not expected to increase the number of
employees beyond the existing 5 per shift. The proposed outdoor seating addition is consistent
with the ordinance parameters and is not expected to increase the parking demand given that it
serves as optional seating in favorable weather conditions and is not intended to allow
additional occupant capacity.
Design Considerations
Outdoor seating is highly encouraged in the General Plan and is consistent with the Heart of the
City Specific Plan requirements for common open space in commercial developments. The
proposed outdoor seating area features a 2'4" high decorative wall approximately 5 feet in front
of a transparent, 5-foot tall glass fence. Existing landscaping will partially screen the low wall.
The design of the outdoor seating area and the wall/glass fence features are compatible with
the existing shopping center and will enhance the existing patio area.

Conclusion
Staff supports the project because it is consistent with the General Plan, Heart of the City
Specific Plan, CG Ordinance, and the previously approved conditions (ASA-2006-14) associated
with Building C in the Marketplace Shopping Center.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Gyu-Kaku Restaurant Cupertino Outside Patio, 19620
Stevens Creek Blvd. Suite 150, Cupertino, CA 95014," prepared by KTA Architecture,
Plaruling, Interior, dated Apri125, 2012 and consisting of 6 sheets labeled T, A1, A2, E-1, E-2,
and E-3; except as may be amended by the conditions contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. FINAL OUTDOOR SEATING AREA DESIGN
The final color and material palate for the outdoor seating and patio area, including,but not
limited to, the low wall and glass fence shall be reviewed and approved by the Director of
Community Development prior to building permit issuance. The Director may approve
minor modifications to the approved plans as deemed appropriate.
4. ABC LICENSING REQUIREMENTS
If the restaurant offers alcoholic beverages, the outdoor seating area shall comply with
California Department of Alcoholic Beverage Control licensing requirements.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective May 30, 2012. The fourteen calendar day appeal
period will expire on June 13,2012.

GENERAL NOTES

Contractor'o responsibility for coordination, code conformance

15. All Contractors and Subcontroctors performing work on,or

all employees are provided a safe place to worlc and the public
is protected,and shall comply with the 'occupational safety
ond health regulation�of the U.S.Department of labor and

16. The Contractor shall coordinate work performed by other
Contractors. Discmpancies, if any,should be brought to the
attention of the Architect for resolution before proceeding
with work.
17. The Contractor sholl perform any and all cutting, patching,
repoiri�g,and roatoring necessary to complete the work and to
restore any damaged or affected surfaces resulting from the
work of this contract to their original condition to the
satistactio�of the Architect and the Owner.
18. Each Subcontractor shall make his own field measurements.
Should any structural difficulties arise over the i�stallatian
of his equipment he shall inform the Contractor, who shall
then inform the Architect.
19. Subcontractors shall verify all as-built conditions and sholl
verify with the Co�tractor as to all finished dimensions on
site prior to finalization and shipment of equipment to insurc
proper installation.
20. The Contractor shall be responsible for the timely arrival of
all specified finish materials, equipme�t,light fixtures and
ony other such material(s) to be utilized on this project.
The Contractor shall notify the Architect in writing within 10
days of the date of contract of those specified items that may
not be readily available and of equal quality and description.
If notification is not received by the Architect,the
Contractor accepts responsibility for the proper ordering and
follow-up of epecified items and will pureue whatever means
necessary at no additionol cost to the Owner,insure
availability of all specified items so as not to create a
hardship on the Owner ond not to delay progress of the worlc.
No extension of time to the contract will be allowed for the
Contractor's inability to sewre specified items.
21. This project ehall conform to the 1994 edition of the UBC, UMC,
UPC, the 1993 edition of the NEC,State Title 24 regulations, and
City and County laws and ordi�ances.
HEALTH DEPARTMENT REQUIREMENTS
1. All floor surfaces of(ood preparation and storage rooms,
dishwashing areas, restrooms and walk-in refrigerator will
be smooth concrete, quarr�or ceramic tile, ond will exte�d
up wall 5-1/2"with 3/8 coved baee. Coving will be eet
flush with wall and feathered ta floor.
2. Walls and ceilings of food preparotion and storage rooms,
restroom, dishwashing area will be emooth ,durable,
�on-obsorbent, and easily deonable.
3. Fly fan on ceilings o(exterior doors will be provided along
with screens of all windows.
4. Necessary floor sinks are provided for all refrigeration
equipment, steam tables, ice machine, etc. as per submitted
plumbing plan, flush with floor and accessible from ceiling.
5. Twenty foot candles of light will be provided for all food
preparation areas with adequate lighting over glaee washing
sink in bar area.
6. All pipes and conduits will be concealed or will be six
inches off the floor.
7. Hot and cold running water will be provided to appropriate
fixtures.
8. Buildinq will be rodent proof and exterior doors will be
within i/4"o(floor. Continuous 12 inch deep footing will
be around perimeter of building for rodent proo(ing.
9. All equipmmt will be on 6"round m�tul legs, al!equipment
on counters, tables, and shelves that are not _�sily lifted
will be on 4"rou�d metal legs.
10. All aisles will be 36'wide or wider for employees.
11. All equipment, flashings and back splashes will be adequately
