Subject: Director's Minor Modification, DIR-2012-12, to a previously approved Use Permit (U-
1970-11) to allow an existing storage and space office space in a residential apartment
to be converted to a second bedroom, bathroom, and closet within the Biltmore
Apartments development located at 10159 S Blaney Ave
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports their decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Anthony Deshaw, representing Prometheus Real Estate Group, is requesting a
modification to a previously approved Use Permit (U-1970-11), which allowed for the
construction of 155 new apartment units (Biltmore Apartments). The floor plan of one of the
existing units includes: a bedroom, storage space, office space, dining/living areas, bathroom,
kitchen, and balcony space. The applicant is requesting to convert the existing storage and
office space into a second bedroom, bathroom, and closet; no additional square footage is being
proposed. The conversion will only affect the interior, so no exterior building changes are
anticipated. The unit is located on the first floor of Building #25 and will not be visible from the
public right-of-way. No tenant currently occupies the unit. The proposed changes include:
• Removal of existing interior walls
� Conversion of an existing office space and storage space to a second bedroom, bathroom,
and closet
• New flooring,walls, doors, and other fixtures to match the existing unit
Staff supports the proposed modifications because they are generally consistent with the
original Use Permit and would not create any adverse impacts to the existing development.
ACTION
The Director of Community Development deems the modification minor and approves the
addition with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on the exhibit titled: "Biltmore Apartments, Carnelian Suite" prepared by
Christiani Johnson Architects, dated December 20, 2011 and consisting of 5 sheets labeled

A2.0, A2.1, A5.0, A6.0, and A6.1, and the site plan entitled, "The Biltmore Apartments" date
stamped April 25, 2012; except as may be amended by the conditions contained in this
resolution.
2. BUILDING PERMIT
The applicant shall be required to obtain the necessary building permits through the
Building Division prior to commencement of work.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
4. CONSTRUCTION HOURS
The applicant is responsible for abiding by the regulations stipulated in the City's
Community Noise Control Ordinance, which limits the hours and maximum noise levels of
permitted construction during daytime and nighttime periods. Construction activities are
not allowed on holidays.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective June 12, 2012. The fourteen calendar day appeal
period will expire on June 26, 2012.
