Subject: Director's Minor Modification, DIR-2012-16, to a previously approved Use Permit (U-
1967-22) for minor site and landscaping changes within the Glenbrook Apartments
located at 10100 Mary Ave
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports their decision to the
City Council and Planning Cominission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Matt LaGoe of Avery Construction, is requesting minor site and landscaping
modifications to an existing apartment complex. A new putting green in the interior of the
project is proposed to replace existing landscaping, located in between several apartment
buildings. No additional square footage, no other exterior building or site work, and no other
changes to the number of parking stalls are planned. The proposed changes include:
• Replace existing concrete areas and landscaping with artificial turf for new putting green
• Install new walkways
• Realign existing walkways
• Provide accessibility upgrades to parking stalls and pathways
• Replace existing wood bridge over river with concrete one
Staff supports the proposed modifications because they are generally consistent with the
original Use Permit and would not create any adverse impacts to the existing development.
ACTION
The Director of Community Development deexns the modification minor and approves the
addition with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on the exhibit titled: "Glenbrook Apt Homes, 10100 Mary Ave,
Cupertino, CA 95014" prepared by Avery Construction and AKC Engineering, dated
February 16, 2012 and consisting of 5 sheets labeled G0.1, C1.1, C1.2, S0.1, and 54.1, except
as may be amended by the conditions contained in this resolution.

2. BUILDING PERMIT
The applicant shall be required to obtain the necessary building permits through the
Building Division prior to commencement of work.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective June 12, 2012. The fourteen calendar day appeal
period will expire on June 26, 2012.
