Dear Mayor and Cupertino Counsel Members.
Sorry that due to schedule conflicts, I won't be able to atte,ld Tuesday night's (May 17. 2012) hearing. You
have heard and met with several of the neighbors who were concerned about the Bollinger Road terminus
development project. We appreciate your efforts in working with us and would like the Developer and City
Counsel to take into considerations of the following improvements as you progress in your approval cycles:
1) To reduce traffic, traffic speed, noise and pollution, during and after construction, please consider adding a
divider similar to the one on Bolliger near I fomeDepot exEt, speed bump, and/or clear Dead-End signs near Kim
Street.
2) Builder to respect affected neighbors i.e., restricted construction hours between 9-5, limited or no weekend
hours. parking for equipment and vehicles inside development court, clean street regularly including
construction debris. nails on nearby streets. and crew garbage/discards. Immediately affected houses such as
953 and 955Vernie Ct. and the 2 neighboring homes on Bollinger terminus should be given compensation to
wash off dirt/dust on the outside of their homes after completion of the project.
3) Additional, tall trees should be planted alongside shared fences, to the hacks, sides and/or fronts of adjacent
homes. to protect the privacy of the new homes and the affected neighbors.

Dear Mayor,
We are glad that you have granted a public hearing for reconsideration of the development project of
the western terminus of Bollinger Road (TM2012-01/V.2012-1) after meeting with several of our
concerned neighbors. We appreciate your efforts in working with us and would like the Developer and
City Counsel to take into considerations of the following improvements:
1) Please consider adding a divider similar to the one on Bolliger Road near HomeDepot exit, and
post a clear Dead-End signs near Kim Street to reduce traffic as well as to slow down traffic speed
and noise pollution.
2) Builder to respect and communicate well with affected neighbors including neighbors along the
Bollinger Road who are beyond the 300 feet radius at least up to the Kim Street for any new or
change of development plans. We found out that a lot of miss-understanding is cleared up by
improving the communication to affected neighbors rather than strictly following the 300 feet guide-
line.
3) Builder should restrict construction hours between 8am-5pm with limited or even no weekend
hours. Builder should try their effort to maintain a dust-free, clean and safe environment during the
construction.
4) Builder should keep their promise of constructing parking spaces along the driveway of individual
new homes in order to avoid constantly overflowing parking cars to neighboring houses.

Dear Vice Mayor,
My name James Xiangqun Xu and I live in 957 Vernie Court.
The City has approved the development of 5 new properties at the western terminus of Bollinger Road that
ignored city property code standards —giving in to the demand of a large developer.
Specifically, 4 out of the five properties under development are in violation of the minimum lot width
requirements. In more than one instance, the entryways is only forty feet wide—20 feet short of the minimum of
60 feet.
We cannot allow the City to compromise community safety by approving code violations in the
developers' favor.
