Subject: Director's Minor Modification, DIR-2012-22, to allow the enclosure of two decks at a
single-family residence located in a RHS zoning district at 11475 Canyon View Circle.
Chapter 19.164 of the Cupertino Municipal Code allows for adinulistrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant is requesting to enclose two existing wood decks with new sunroom enclosures.
The northerly deck is 90 square feet in area and the southerly deck is 238 square feet in area for
a total square foot addition of 328 square feet. This would increase the total square footage of
the residence to 3,600 square feet, which is less than 6,457 square feet --the maximum RHS-
building area allowed for this lot.

The residence is situated on a prominent ridgeline, so any addition requires City review and
visual analysis to determine if valley floor views will be impacted from the new additions. The
valley floor is downslope from the residence and to the east. Views are analyzed from six city-
adopted valley view vantage points:
Foothill Boulevard&Alpine Drive;
Bellevue Avenue &Carmen Road;
Foothill Boulevard&Cristo Rey Drive;
Hyannisport Drive& Bubb Road;
Hyannisport Drive&Linda Vista Drive;and
Weymoth Drive and Rainbow Drive
The applicant's visual analysis, consisting of photographs of the west foothills from each of the
vantage points, demonstrated that there is no visibility of the residence (and additions) from the
valley floor vantage points. The northerly proposed sun room is west of the residence and
completely screened by the home. The southerly proposed sun room fills a notch in the
residence and only a 6'2" wide section of the enclosure protrudes from the length of the home.
This section is also not visible. Staff is supportive of the proposal because of the lack of
visibility of the addition from valley view vantage points and the general design compatibility
of the addition and the residence.
ACTION
The Director of Community Development deems the modification minor and approves the
addition with the following condition of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "(2) NEW ENCLOSED SUNROOMS 328 SF" prepared
by CCS, and undated, consisting of 7 sheets labeled A-1 through A-7; except as may be
amended by the conditions contained in this resolution.
2. NOTICE OF FEES, DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective June 19,2012. The fourteen calendar day appeal
period will expire on July 3, 2012.
