SUBJECT: RESIDENTIAL DESIGN REVIEW PERMIT ACTION LETTER—Application R-2012-21:
This letter confirms the decision of the Director of Community Development, given on June 26,
2012; approving a Residential Design Review for a new 2,385 square foot, two story single
family home with second floor setbacks of 10'2" and 14'105i$",with the following conditions:
l. APPROVED PROTECT
This approval is based on a plan set entitled, "New Custom Home, Mr. & Mrs. Jalili, 10310
Moretti Drive, Cupertino, CA 95014," consisting of 12 sheets labeled AO-A8 (continuous)
and C-1-C-3,dated 03/08/12;except as may be amended by conditions in this resolution.
2. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the
building plans.
3. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easements and/or construction records. Any misrepresentation
of any property data may invalidate this approval and may require additional review.
4. ARCHITECTURAL REVIEW COMPLIANCE
The project shall remain in substantial conformance with the recommendations outlined in
Cannon Design Group's architectural review letter dated April 10, 2012. These
recommendations shall be shown on the construction plans prior to issuance of building
permits and verified prior to final occupancy.
5. LOT COVERAGE
The applicant shall correct lot coverage information shown on Page AO upon building
permit submittal.
6. FENCE CONSTRUCTION
All fences constructed in the R1 Zoning district must conform to the Fence Ordinance,
Chapter 19.48. The location of all existing fences and new fence shall be indicated on the
building plans.

7. FRONT YARD TREE
The applicant shall plant a new 24-inch box front yard tree (6 foot tall at planting) in front of
the second story. The Director of Community Development may waive this condition based
on a report from an ISA-certified arborist citing conflict with existing mature tree canopies
onsite or in the public right-of-way.
8. PRIVACY PLANTING
The final privacy-planting plan shall be reviewed and approved by the Planning Division
prior to issuance of building permits. If existing tree(s) is used for privacy screening, a letter
from a certified arborist shall be submitted confirming that the tree(s) is in good condition
and is appropriate privacy protection in any season.
9. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements consistent with
the R-1 Ordinance, for all windows with views into neighboring yards and a sill height that
is 5 feet or less from the second-story finished floor. The precise language will be subject to
approval by the Director of Community Development. Proof of recordation must be
submitted to the Community Development Department prior to final occupancy of the
residence.
10. LANDSCAPE AND IRRIGATION PLAN
Prior to issuance of building permits, detailed landscape and irrigation plans in
conformance with the landscape project submittal requirements of Chapter 14.15,
Landscape Ordinance, shall be submitted, if a landscape project submittal is required per
Section 14.15.020. The landscape plan shall include water conservation and pesticide
reduction measures in conformance with Chapter 14.15, and the pesticide control measures
referenced in Chapter 9.18, Stormwater Pollution Prevention and Watershed Protection, of
the Cupertino Municipal Code.
11. LANDSCAPE AND IRRIGATION INSTALLATION REPORT
Prior to final inspection, a landscape installation audit shall be conducted by a certified
landscape professional after the landscaping and irrigation system has been installed, if a
landscape project submittal is required per Section 14.15.020. The findings of the assessment
shall be consolidated into a landscape installation report.
The landscape installation report shall include, but is not limited to: inspection to confirm
that the landscaping and irrigation system are installed as specified in the landscape and
irrigation design plan, system tune-up, system test with distribution uniformity, reporting
overspray or run-off that causes overland flow,and preparation of an irrigation schedule.
The landscape installation report shall include the following statement: "The landscape and
irrigation system have been installed as specified in the landscape and irrigation design plan
and complies with the criteria of the ordinance and the permit."
12. LANDSCAPE AND IRRIGATION MAINTENANCE SCHEDULE
Per the Landscape Ordinance (Chapter 14.15), a maintenance schedule shall be established
and submitted to the Director of Community Development or his/her designee, either with
the landscape application package,with the landscape installation report, or any time before

the landscape installation report is submitted, is a landscape project submittal is required
per Section 14.15.020.
a. Schedules should take into account water requirements for the plant establishment
period and water requirements for established landscapes.
b. Maintenance shall include, but not be limited to the following: routine inspection;
pressure testing, adjushnent and repair of the irrigation system; aerating and de-
thatching turf areas; replenishing mulch; fertilizing; pruning; replanting of failed plants;
weeding;pest control;and removing obstructions to emission devices.
c. Failed plants shall be replaced with the same or functionally equivalent plants that may
be size-adjusted as appropriate for the stage of growth of the overall installation. Failing
plants shall either be replaced or be revived through appropriate adjustments in water,
nutrients,pest control or other factors as recommended by a landscaping professional.
13. LANDSCAPE AND IRRIGATION MAINTENANCE AGREEMENT
Prior to final inspections and final occupancy, the owner(s) of the property shall enter into a
formal written landscape maintenance agreement with the City, if a landscape project
submittal is required per Section 14.15.020. The City shall record this agreement, against the
property or properties involved, with the County of Santa Clara Recorder's Office and it
shall be binding on all subsequent owners of land served by the proposed landscape. The
landscape maintenance agreement shall require that modifications and maintenance
activities not alter the level of water efficiency of the landscape from its original design,
unless approved by the City prior to the commencement of the proposed modification or
maintenance activity.
14. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
15. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color,
material, architectural treatments and/or embellishments) shall be reviewed and approved
by the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resemble the details shown on the original approved
plans. Any exterior changes determined to be substantial by the Director of Community
Development shall require a minor modification approval with neighborhood input.
16. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a),has begun. If you fail to file a protest within this 90-day period complying

with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Please note that if this permit is not vested within two years, it shall expire on June 26, 2013.
Staff has made all the findings that are required for approval of a Residential Design Review as
required by the of Cupertino's Municipal Code, Chapter 19.28.150 (C). Also, please note that an
appeal of this decision can be made within 14 calendar days from the date of this letter. If
this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.

PUBLIC WORKS NOTES
1. Approval of these plans does not release the Contractor of the
responsibility for the corrections of mistakes, errors, or amissions contained
therein. If, during the course of construction of improvements, public
interest requires a modificatio� of/or a departure from the City of
Cupertino specification or these improvement plans, the City Engineer shall
have the outhority to require such modification or departure and to specify
the manner in which the same is to be completed., at the sole expense of
the owner ond/or controctor.
2. Contact City Public Works at (408) 777-3104 to schedule inspection of
grading, storm drainage and public improvements.
3. All public improvements must be completed prior to occupancy.
4. Contractor is responsible for dust, sediment and trash control and ensuring
all areas adjacent to the work is left in a clean condition.
5. Contractor shall review and implement as appropriate City Standard Detail
6-4"Tree Protection Standards" prior to any work or removing any trees.
6. Utilize Best Management Practices(BMP's), as required by the State Water
Resources Control Board, for ANY activity which disturbs the soil.
7. A work schedule of grading and Erosion &Sediment Control Plon shall be
provided to the City Engineer by August 15. No hillside grading shall be
performed between October 1 to April 15,
8. All new electrical service (power, telephone, and/or cable service) shall be
undergrounded.
9. To initiote release of bonds, contact City Public Works Dept for Final
Inspection.
10. All downspouts released at ground surface, shall be directed away from
building foundations and to landscaped areas(ie, using splash blocks or
other means).
11. Prior to beginning work within the Public Right of Way(Driveway, Curb and
Gutter, etc.), Contractor shall obtain an encroachment permit from the City
Public Works Department.
SANITARY SEWER NOTES
1. All wa-k performed shall be installed to manufacturers specifications and all work shall comply
with all current local, state and federal requirements.
2. All work shall be constructed in accordance with these plans and the Standard Specifications of
the Cupertino Sanitary Distriet.
3. All excavation and backflling within street right-of-way shall be done in accordance with the
requirements of the Engineer of the public agency having jurisdiction. Encroachment Permits shall
be obtained and a copy shall be on the job during construction.
4. Fiil material shall be compacted to o minimum of two and one half(2.5)feet obove the top of
pipe elevation by methods that will not damage the pipe or substituted wtth gravel or one(1)
slurry mix. Fill material must attain a minimum of ninety five percmt(95'l.)relative compaction,
as per State of California Standard Specifications.
5. The District Engineer shall be notified two(2) working days in advance of starting construction
on this project, 20065 Stevens Creek Boulewrd,Bulding C, Cupertino,CA 95014(408) 253-7071.
At that time, traffic plans,encroachment permits and the sewer diversion plans shall be given to
the District Engineer. Sewer diversion plans shall include sewage bypass and emergency plans.
Work shall not begin unti the District Engineer has provided written acceptance of these plans.
6.One(1)sanitory sewer lateral sholl be installed for each lot or building. Location of lateral and
property corners to be stakcd in field at the same time the sewer main is staked for construction.
Laterals shall not be laid on less than two percent(2%) grade and shall have a minimum cover of
four and one half(4.5)feet at property line or edge of sanitary sewer easement. Laterals shall be
deeper than four and one holf(4,5)feet when directed by District Engineer. �aterols shal� not be
extended beyond the street right-of-way line or sanitary sewer easement line until the main has
been tested. Lateral sewers constructed outside of the public street or Cupertino Sanitary District
Easement shall be constructed in accordance with the requirements of,and shall be inspected by
the City of Cupertino Building Department.
7. The Contractor performing work on the sanitary sewers shall be required to register with the
District and provide insuranee as specified in Sections 1.39 and 1.40 of the District's Standard
Specificationa
8. The Developer and General Contractor shall be respo�sible for protectio� of all existing
improvements including existing sanitary sewer facilities that ore to remain ond if damaged during
co�structian of the proposed improvements,shall be repoired to the satisfaction of the Cupertino
Sonitary District and other offected agencies.
9.Chonnels of all District manholes within the construction area shall be protected by plywood
covers, ploced in the monholes and manhole easti�gs shall be adjusted to final grade in accordonce
with the Standard Specifications of the Cupertino Sanitary District or as directed by the District
Engineer.
10. The Developer and General Contractor shall be responsible for the prevention of construction
debris entering the existing sanitary sewer system due to the construction activities associated with
this project and the Developer ond Contraetor shall pay all costs associated with the rdease of
construction debris into the existing sanitary sewer system due to the construction activities
associated with this project.
11.The Developer and General Contractor shall be responsible for the prevention of a sewage spill
associated the Contractoro activities on this project and the Developer and Contractor shall pay all
costs ossocioted with the release of sewage into surface drainage system and downstream surface
waters.
12. Utility Notification(Contractor shall locate all utilities prior to start of excavation):

13. All Sanitary Sewer Pipes shall be PVC-SDR26 or approved equal,unless otherwise specified by
the District Engineer.
14.Access for pedestrians and vehicles shal� be provided at all times unless approved in writing
by District Engineer.
15. VIDEOTAPE INSPECTION OF THE EXISTING/NEW PROPERTY UNE CLEANOUT, POINT OF
CONNECTION AND STREET LATERAL IS RE4UIRED PRIOR TO PASSING THE CITY OF CUPERTINO FINAL
INSPECTION. OWNER TO CALL DISTRICT 48 HOURS PRIOR TO VIDEO INSPECTION TO SCHEDULE A
DISTRICT INSPECTOR. DISTRICT TO PROVIDE BUILDIN�DEPARTMENT WHIT WRITTEN NO?1FlCAT10N
UPON COMPLETION OF INSPECTION.
Approval of these pla�s by Cupertino Sanitary District does not relieve the installer of the

UTILI T Y NO TE S:
1. CONTRACTOR SHALL VERIFY THE LOCATION OF ALL UTILITIES PRIOR TO
CONSTRUCTION.
2. CONNECT SANITARY SEWER AND WATER LINES TO EXISTING STREET LATERALS.
3. CONNECT GAS AND ELECTRIC LJNES TO EXISTING STREEf LATERALS,
PER PG&E STANOAROS.
4. CONTRACTOR SHALL COORDINATE ANY DISRUPTIONS TO EXISIING
UTILITY SERVICES WITH ADJACENT PROPERiY OWNERS.
5. ALL ELECTRIC,TELEPHONE AND GAS EXTENSIONS INCLUDING SERVICE
LINES SHALL BE CONSTRUCTED TO THE APPROPRIAtE UTILITY COMPANY
SPECIFICATIONS.ALL UTILITY DISCONNECTIONS SHALL BE COORDINATED
WITH THE DESIGNATED UTILITY COMPANIES.
6. PRIOR TO THE CONSTRUCTION OF OR CONNECTION TO ANY STORM DRAIN,
SANITARY SEWER, WATER MAIN OR ANY OF THE DRY UTILITIES, THE
CONTRACTOR SHALL EXCAVATE,VERIFY AND CALCULATE ALL POINTS OF
CONNECTION AND ALL UTILITY CROSSING AND INFORM THE OWNER/
DEVELOPER OF ANY CONFLJCT OR REQUIRED DEVIATIONS FROM THE PLANS.
