Subject: Director's Minor Modification, DIR-2012-27, for rear yard landscaping enhancements
at a residence located in the Oak Valley Planned Development District at 10998
Sycamore Drive
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Kevin Troyan, representing Bob Gottlieb and Jill McDonough, is requesting to
make rear yard landscaping enhancements at an existing single-family residence at 10998
Sycamore Drive. The subject property is located in the Oak Valley Planned Development
District, and any significant exterior changes require approval by the Director of Community
Development.
The proposed enhancements include:
• Native, drought tolerant, and fire-resistant plantings in the rear private open space
easement
• New low water use drip irrigation system and landscaping
• Significant reduction of existing grass lawn area and replacement with synthetic turf
• Reconfiguration of patio hardscape area
• New storage shed
• New trellis and outdoor barbeque area
• New hot tub and fire pit with seat walls
• Upgrade of underground gas and electric lines
The proposed rear yard accessory structures, hardscape, and landscaping enhancements are
consistent with the City's ordinance and the pertinent development standards and design
guidelines prescribed in the Oak Valley Planned Development District.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:

Approval is based on exhibits titled: "Gottlieb Residence, 10998 Sycamore Drive, Cupertino,
CA," prepared by West Bay Landscape Co. dated July 6, 2012 and consisting of 4 sheets
labeled L1, L2, L3, and L4; except as may be amended by the conditions contained in this
resolution. This approval consists of the new landscaping, hardscape, irrigation, and
accessory structures shown on the approved exhibits.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirernents. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. COMPLIANCE WITH OAK VALLEY USE PERMIT CONDITIONS
The project shall comply with all applicable conditions of Oak Valley Use Permit no. U-
1997-06.
4. BUILDING PERMIT
The applicant shall be required to obtain the necessary building permits through the
Building Division prior to commencement of work.
5. OUTDOOR LIGHTING
The outdoor lighting shall be installed so that there are no off-site glare impacts to adjoining
residential properties and the public open space easement area to the rear.
6. PROTECTED TREE COVENANT
Prior to final approval, the property owner shall be required to record a covenant with the
Santa Clara County Recorder's Office requiring that the new tree plantings shall be
maintained as protected trees in accordance with the City's Protected Trees Ordinance.
Failure to do so may result in code enforcement and/or administrative citations.
7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective July 19, 2012. The fourteen calendar day appeal
period will expire on August 2, 2012.
