Subject: Director's Minor Modification, DIR-2012-32, to allow tree relocations,as well as minor
site, ADA, and landscaping changes at an existing office complex in a planned
development located at 10000 Torre Ave
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of xninor changes in a project. The Director reports their decision to the
City Council and Plarming Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Reel Grobman Architecture + Interiors, is requesting minor site, ADA, and
landscaping changes at an existing office complex. No other exterior building modifications, site
work, or changes to the number of parking stalls are planned. The proposed improvements
include:
• Relocate five (5) of the existing Crape Myrtle trees on-site, ranging in size from 2.2" - 3.5"
inches in diameter
• Remove and replace the existing bike racks
• Upgrade parking stalls and pathways to conform to ADA standards (including pedestrian
path striping,new accessibility signage,handrails,and pavers)
• Remove and replace landscaping associated with the project to match existing
Staff supports the proposed modifications because they are generally consistent with the
existing office complex and would not create any adverse impacts to the existing development.
ACTION
The Director of Community Development deems the modification minor and approves the
addition with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "TR-02 Building Permit Package° prepared by Reel
Grobman Architecture + Interiors, dated August 13, 2012 and consisting of 5 sheets labeled
A-0.0, A-0.1, 1, A-0.11, and A-0.12;except as may be amended by the conditions contained in
this resolution.

2. BUILDING PERMIT
The applicant shall be required to obtain the necessary building permits through the
Building Division prior to commencement of work.
3. TREE RELOCATIONS
Prior to final occupancy, the applicant must demonstrate that the relocations of the five
Crape Myrtle trees have been properly executed and the health and structures of the trees
are in good condition to the satisfaction of the Director of Community Development.
4. WHEEL STOPS
Prior to issuance of building permits, applicant shall illustrate wheel stops for all parking
stalls on construction plan sets.
5. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
6. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective September 20,2012. The fourteen calendar day
appeal period will expire on October 4, 2012.
